(3) The court shall inform <strong>the</strong> legal representative <strong>of</strong> <strong>the</strong> person to whom compulsory medical<br />

measure are applied, administration board <strong>of</strong> <strong>the</strong> medical institution, defense attorney and<br />

prosecutor <strong>of</strong> <strong>the</strong> person. Participation <strong>of</strong> <strong>the</strong> defense attorney and prosecutor in <strong>the</strong> session<br />

<strong>of</strong> <strong>the</strong> court is mandatory, non-appearance <strong>of</strong> o<strong>the</strong>r persons shall hamper consideration <strong>of</strong> <strong>the</strong><br />

case.<br />

(4) Decision <strong>of</strong> <strong>the</strong> medical institution, conclusion <strong>of</strong> <strong>the</strong> commission <strong>of</strong> psychiatrists shall be<br />

investigated, opinions <strong>of</strong> parties participating in <strong>the</strong> trial shall be heard in <strong>the</strong> trial. If <strong>the</strong><br />

conclusion <strong>of</strong> <strong>the</strong> commission <strong>of</strong> psychiatrists is doubtful <strong>the</strong> court may assign forensic<br />

psychiatric expertise by petition <strong>of</strong> participating persons or by its own initiative, require<br />

additional documents, and also question <strong>the</strong> person in relation to whom <strong>the</strong> issue <strong>of</strong> recall,<br />

change or extension <strong>of</strong> <strong>the</strong> application <strong>of</strong> compulsory medical measures if <strong>the</strong> psychiatric<br />

condition allows to do so.<br />

(5) The court shall recall or change <strong>the</strong> compulsory medical measure in if <strong>the</strong> psychiatric<br />

condition <strong>of</strong> <strong>the</strong> person excludes <strong>the</strong> necessity to prescribe o<strong>the</strong>r medical measure. The court<br />

shall extend <strong>the</strong> compulsory treatment if <strong>the</strong>re are no reasons to recall or change <strong>the</strong><br />

compulsory medical measure.<br />

(6) In <strong>the</strong> session room <strong>the</strong> court shall make a decision on recall, change or extension, as well as<br />

refuse to recall, change or extend <strong>the</strong> application <strong>of</strong> compulsory medical measure and read it<br />

in <strong>the</strong> court’s session.<br />

Article 416. Revivor in Relation to <strong>the</strong> Person to Whom <strong>the</strong> Compulsory Medical Measure<br />

is Applied<br />

(1) If <strong>the</strong> person to whom <strong>the</strong> compulsory medical measure is applied because has got mental<br />

disturbance after committing a crime is recognized as cured by <strong>the</strong> commission <strong>of</strong><br />

psychiatrists <strong>the</strong> court shall make a decision to suspend application <strong>of</strong> compulsory medical<br />

measure basing on <strong>the</strong> conclusion <strong>of</strong> <strong>the</strong> medical institution and according to rules specified<br />

in <strong>the</strong> third part <strong>of</strong> Article 364 <strong>of</strong> this <strong>Code</strong> and shall consider <strong>the</strong> issue <strong>of</strong> sending <strong>of</strong> <strong>the</strong> case<br />

for investigation procedure, summon <strong>of</strong> this person as an accused and transfer <strong>of</strong> <strong>the</strong> case to<br />

<strong>the</strong> court on general bases.<br />

(2) Time spent in <strong>the</strong> medical institution shall be included in <strong>the</strong> term <strong>of</strong> sentence.<br />

CHAPTER 46. PROCEEDING ON THE RESTITUTION OF DAMAGES INCURRED<br />

BY UNLAWFUL ACTIONS OF THE COURT AND BODIES PROSECUTING THE<br />

CRIMINAL CASE.<br />

Article 417. Bases and Conditions <strong>of</strong> Formation <strong>of</strong> <strong>the</strong> Right to Restitution <strong>of</strong> <strong>the</strong> Damage<br />

(1)Damage harmed to a citizen as a result <strong>of</strong> unlawful:<br />

1) detention;<br />

2) custody;<br />

3) dismissal from <strong>of</strong>fice;<br />

4) placement in <strong>the</strong> medical institution;<br />

5) conviction;<br />

6) application <strong>of</strong> compulsory medical measures,
