a witness and a victim have <strong>the</strong> right to wave providing testimony that establish <strong>the</strong>ir or <strong>the</strong>ir<br />
close relatives’ guilt in committing crimes. Any witness or victim waved this right shall be<br />
warned about a criminal responsibility for providing intentionally wrong information. An<br />
entry shall be made into a transcript <strong>of</strong> proceedings on explanation to a witness or victim<br />
<strong>the</strong>ir rights and responsibilities, warning on a criminal responsibility for <strong>the</strong> wave or<br />
deviation to provide testimony and for providing a deliberately wrong testimony and that<br />
shall be certified with a signature <strong>of</strong> an interrogated.<br />
(3) Any interrogation <strong>of</strong> a witness or a victim shall be enforced according to <strong>the</strong> rules stipulated<br />
by Article 191 <strong>of</strong> this <strong>Code</strong>.<br />
Article 193. Special features <strong>of</strong> interrogation <strong>of</strong> a juvenile witness or victim<br />
(1) If an interrogated wittiness or victim has not reached 14 years old, and upon <strong>the</strong><br />
investigator’s consideration when he is at <strong>the</strong> age from 14 till 16 years old, a pedagogue shall<br />
be called for interrogation. Authorized representatives <strong>of</strong> a juvenile interrogated as a witness<br />
or victim shall be authorized to be present at interrogation.<br />
(2) Witnesses and victims at <strong>the</strong> age under 16 years old shall not be warned about <strong>the</strong><br />
responsibility for a wave to provide testimony and providing <strong>of</strong> a deliberately wrong<br />
information. In <strong>the</strong> course <strong>of</strong> explanation to such witness and victims <strong>of</strong> <strong>the</strong>ir procedural<br />
rights and responsibilities <strong>the</strong>y shall be announced that it is necessary for <strong>the</strong>m to tell only <strong>the</strong><br />
truth. Any juvenile witness or victim shall be explained <strong>the</strong> right to wave providing<br />
testimony that establishes <strong>the</strong>ir or <strong>the</strong>ir close relatives’ guilt in committing a crime. An entry<br />
shall be made in a transcript <strong>of</strong> proceedings on <strong>the</strong> explanation <strong>of</strong> rights and responsibilities<br />
that shall be certified with a signature <strong>of</strong> a witness or a victim.<br />
(3) The present at interrogation persons specified in item 1 <strong>of</strong> this Article shall be explained <strong>the</strong><br />
right to make remarks that are to be entered into a transcript <strong>of</strong> proceedings on <strong>the</strong> violation<br />
<strong>of</strong> rights and legal interests <strong>of</strong> interrogated and, upon <strong>the</strong> investigator’s permission, to ask an<br />
interrogated questions. Any interrogator shall be authorized to draw a question <strong>of</strong>f but he<br />
shall enter it into a transcript <strong>of</strong> proceedings and specify a reason for drawing a question <strong>of</strong>f.<br />
Article 194. Utilization <strong>of</strong> audio and video recording in <strong>the</strong> course <strong>of</strong> interrogation<br />
(1) Upon <strong>the</strong> investigator’s decision audio and video recording may be utilized in <strong>the</strong> course <strong>of</strong><br />
interrogation <strong>of</strong> <strong>the</strong> suspect, accused, victim, or witness. Audio and video recording may be<br />
also utilized upon a request <strong>of</strong> <strong>the</strong> suspect, accused, victim or witness.<br />
(2) Having taken a decision on utilization <strong>of</strong> an audio or video recording <strong>the</strong> investigator shall<br />
inform <strong>the</strong> accused about that before an interrogation.<br />
(3) Audio and video records shall reflect <strong>the</strong> information specified in items 3 and 4 <strong>of</strong> Article<br />
170 <strong>of</strong> this <strong>Code</strong> and <strong>the</strong> whole course <strong>of</strong> interrogation. Audio and video recording only <strong>of</strong> a<br />
part <strong>of</strong> interrogation as well as a repetition especially for recording <strong>of</strong> some testimony<br />
provided in <strong>the</strong> course <strong>of</strong> <strong>the</strong> same interrogation shall be prohibited.<br />
(4) After <strong>the</strong> completion <strong>of</strong> an interrogation an audio or video tape shall be fully played to an<br />
interrogated. After <strong>the</strong> completion <strong>of</strong> listening to or watching <strong>the</strong> tape an interrogated shall<br />
be asked whe<strong>the</strong>r he has some additions to <strong>the</strong> said by him and whe<strong>the</strong>r he certifies <strong>the</strong><br />
correctness <strong>of</strong> <strong>the</strong> record. Additions to <strong>the</strong> audio and video records <strong>of</strong> testimony shall be
