(2) Rules <strong>of</strong> <strong>the</strong> first part <strong>of</strong> this article are not extended to cases when <strong>the</strong> crime is committed by<br />

<strong>the</strong> person after his extradition.<br />

Article 433. Enforcement <strong>of</strong> a Claim to Extradite a Citizen <strong>of</strong> a Foreign State<br />

(1) The claim to extradite a citizen <strong>of</strong> a foreign state who is accused in committing a crime, or<br />

convicted on <strong>the</strong> territory <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> shall be considered by <strong>the</strong> General<br />

Prosecutor <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> or his Deputy. If <strong>the</strong>re are claims <strong>of</strong> several states to<br />

extradite a person <strong>the</strong> General Prosecutor shall make decision which state <strong>the</strong> person is to be<br />

extradited to.<br />

(2) Conditions and procedure <strong>of</strong> extradition are established by this <strong>Code</strong> or international<br />

agreement <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> with foreign states.<br />

(3) In case when a citizen <strong>of</strong> a foreign state in relation to whom <strong>the</strong>re is a request on extradition,<br />

is serving sentence for o<strong>the</strong>r crime on <strong>the</strong> territory <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>, extradition may<br />

be postponed till <strong>the</strong> end <strong>of</strong> <strong>the</strong> sentence or release from liability by any legal reason. If <strong>the</strong><br />

citizen is instituted <strong>the</strong> criminal proceeding his extradition may be postponed till <strong>the</strong> issue <strong>of</strong><br />

<strong>the</strong> verdict, service <strong>of</strong> <strong>the</strong> sentence or release form <strong>the</strong> criminal responsibility or punishment<br />

for any reason. If <strong>the</strong> delay <strong>of</strong> <strong>the</strong> extradition may entail expiration <strong>of</strong> <strong>the</strong> limitation period <strong>of</strong><br />

<strong>the</strong> criminal persecution or bring harm to investigation <strong>of</strong> <strong>the</strong> crime, a person who is required<br />

to be extradited according to <strong>the</strong> petition may be extradited temporarily.<br />

Article 434. Refuse to Extradite<br />

Extradition shall not allowed if:<br />

1) <strong>the</strong> person has been granted political asylum by <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>;<br />

2) <strong>the</strong> action serving a reason for <strong>the</strong> claim on extradition is acknowledged by <strong>the</strong> <strong>Kyrgyz</strong><br />

<strong>Republic</strong> as a crime;<br />

3) <strong>the</strong> verdict has already been issued or <strong>the</strong> proceeding <strong>of</strong> <strong>the</strong> case has been suspended in<br />

relation to <strong>the</strong> person for <strong>the</strong> same crime which has come into force;<br />

4) according to <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> <strong>the</strong> criminal case cannot be initiated or <strong>the</strong> verdict cannot<br />

be implemented as a result <strong>of</strong> expiration <strong>of</strong> <strong>the</strong> limitation period or by o<strong>the</strong>r legal bases.<br />

Article 435. Custody for Extradition<br />

(1) In receiving a properly formulated claim from <strong>the</strong> competent institution <strong>of</strong> a foreign state and<br />

if <strong>the</strong>re are legal grounds for extradition <strong>of</strong> a person he may be detained, and he shall applied<br />

penalty in <strong>the</strong> form imprisonment in <strong>the</strong> procedure established in Article 110 <strong>of</strong> this <strong>Code</strong>.<br />

(2) The institution <strong>of</strong> a foreign state having sent a request <strong>the</strong> extradition with <strong>the</strong> proposal <strong>of</strong><br />

time and place <strong>of</strong> extradition shall immediately be informed on custody <strong>of</strong> <strong>the</strong> person.<br />

(3) If <strong>the</strong> extradition does not happen within thirty days a detained person is to be released by <strong>the</strong><br />

decision <strong>of</strong> <strong>the</strong> prosecutor. Repeated detention shall be allowed only after consideration <strong>of</strong><br />

<strong>the</strong> new claim on extradition according to <strong>the</strong> first part <strong>of</strong> this article.
