4) if <strong>the</strong> end <strong>of</strong> a time limit is not a working day, <strong>the</strong> last day <strong>of</strong> <strong>the</strong> time limit shall be <strong>the</strong><br />

first working day after a week-end or a holiday except for <strong>the</strong> cases <strong>of</strong> calculation <strong>of</strong> a<br />

time limit for those who are detained, are in custody or in a medical center.<br />

5) when detained, a time limit shall be calculated from <strong>the</strong> moment (hour) <strong>of</strong> <strong>the</strong> actual<br />

enforcement <strong>of</strong> <strong>the</strong> sanction.<br />

(3) The time limit shall not be considered expired if an appeal, motion or o<strong>the</strong>r document is filed<br />

with a post <strong>of</strong>fice or given or declared to <strong>the</strong> person authorized to take it and for persons who<br />

are in custody or are in a medical center—if an appeal or o<strong>the</strong>r document is filed with <strong>the</strong><br />

administration <strong>of</strong> <strong>the</strong> detention center or medical center before <strong>the</strong> expiration <strong>of</strong> <strong>the</strong> time<br />

limit.<br />

Article 145. Extension and Restoration <strong>of</strong> <strong>the</strong> Missed Time Limit<br />

(1) Time limits <strong>of</strong> proceedings may be extended only in cases and according to procedures<br />

stipulated by this <strong>Code</strong>.<br />

(2) Missed due to some valid cause time limit shall be restored upon a resolution <strong>of</strong> <strong>the</strong><br />

investigator or <strong>the</strong> judge. The denial to restore a time limit may be appealed according to <strong>the</strong><br />

established procedure.<br />

(3) On motion <strong>of</strong> an interested person, an execution <strong>of</strong> <strong>the</strong> appealed decision upon <strong>the</strong> course in<br />

which a time limit was missed shall be suspended until <strong>the</strong> resolution regarding on<br />

restoration <strong>of</strong> <strong>the</strong> missed time limit is taken.<br />

Article 146. Procedural Costs<br />

(1) Procedural costs shall consist <strong>of</strong>:<br />

1) <strong>the</strong> amounts paid to witnesses, victims and <strong>the</strong>ir representatives, experts, specialists,<br />

interpreters in order to cover <strong>the</strong>ir expenses to arrive to <strong>the</strong> place proceedings and to<br />

return back, to rent dwelling and to pay per diem.<br />

2) amounts paid to witnesses, victims and <strong>the</strong>ir representatives who do not have permanent<br />

salaries for <strong>the</strong>ir distraction from usual occupation;<br />

3) amounts paid to witnesses, victims and <strong>the</strong>ir legal representatives who have permanent<br />

jobs and have permanent salaries in order to reimburse <strong>the</strong> unpaid amounts for <strong>the</strong> time<br />

spent because <strong>of</strong> being summoned by <strong>the</strong> investigator or court;<br />

4) reimbursement <strong>of</strong> experts, interpreters, specialists for <strong>the</strong> execution <strong>of</strong> <strong>the</strong>ir<br />

responsibilities in <strong>the</strong> course <strong>of</strong> investigation or in court except cases when such<br />

responsibilities were executed as <strong>of</strong>ficial duties;<br />

5) amounts paid for providing legal aid in cases when <strong>the</strong> suspect, accused is released from<br />

<strong>the</strong> payment or when a defense attorney participates in an investigation or in court upon<br />

assignment without a contract;<br />

6) amounts spent on safe-keeping and sending <strong>of</strong> material evidence;<br />

7) amounts spent on search <strong>of</strong> <strong>the</strong> suspect, accused escaped from <strong>the</strong> investigation or court;<br />

8) amounts spend on conducting expert examination in expert institutions;<br />

9) o<strong>the</strong>r expenses made in <strong>the</strong> course <strong>of</strong> prosecution.<br />

(2) Amounts mentioned in subitems 1-5, 8 <strong>of</strong> item 1 <strong>of</strong> his Article shall be paid based upon a<br />

resolution <strong>of</strong> <strong>the</strong> investigator, judge or court ruling.
