compulsory medical measures or transfer him/her to medical institutions or relatives to take<br />

care <strong>of</strong>.<br />

(3) When releasing convicts who have started to suffer from a serious illness that hamper <strong>the</strong>m<br />

from serving out <strong>the</strong>ir sentences any fur<strong>the</strong>r, except convicts suffering from mental<br />

disorders, <strong>the</strong> judge shall take into account <strong>the</strong> gravity <strong>of</strong> <strong>the</strong> committed crime, <strong>the</strong> convict’s<br />

personality and o<strong>the</strong>r circumstances.<br />

(4) Releasing <strong>the</strong> convict from fur<strong>the</strong>r serving out <strong>the</strong> sentence due to an illness, <strong>the</strong> court shall<br />

have <strong>the</strong> right to release him/her not only from <strong>the</strong> criminal grounds, but also from any<br />

additional penalties.<br />

Article 364. Courts Dealing with Issues Related to <strong>the</strong> Execution <strong>of</strong> Verdicts<br />

(1) Issues related to <strong>the</strong> deferment <strong>of</strong> <strong>the</strong> execution <strong>of</strong> a verdict pursuant to Article 362 <strong>of</strong> this<br />

<strong>Code</strong>, to release from serving <strong>the</strong> sentence due to <strong>the</strong> expiration <strong>of</strong> <strong>the</strong> prescription term <strong>of</strong> a<br />

guilty verdict, as well as unclear and doubtful issues, arising in <strong>the</strong> course <strong>of</strong> execution <strong>of</strong> a<br />

verdict, shall be resolved by <strong>the</strong> court that has deduced <strong>the</strong> verdict.<br />

(2) If a verdict is executed outside <strong>of</strong> <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> court that has inferred <strong>the</strong> verdict,<br />

<strong>the</strong>se issues shall be resolved by <strong>the</strong> court under which jurisdiction <strong>the</strong> location <strong>of</strong> <strong>the</strong><br />

execution <strong>of</strong> <strong>the</strong> verdict falls. If this is <strong>the</strong> case, a copy <strong>of</strong> <strong>the</strong> injunction shall be sent to <strong>the</strong><br />

court that has deduced <strong>the</strong> original verdict.<br />

(3) Regardless <strong>of</strong> what court has inferred <strong>the</strong> original verdict, <strong>the</strong> court with <strong>the</strong> jurisdiction over<br />

<strong>the</strong> area where <strong>the</strong> convict serves <strong>the</strong> sentence shall resolve issues <strong>of</strong> <strong>the</strong> premature<br />

discharge <strong>of</strong> <strong>the</strong> convict due to a serious illness, <strong>of</strong> <strong>the</strong> replacement <strong>of</strong> <strong>the</strong> unserved portion<br />

<strong>of</strong> <strong>the</strong> sentence with a mitigated penalty, <strong>of</strong> <strong>the</strong> cessation <strong>of</strong> application <strong>of</strong> a compulsory<br />

medical measure coupled with <strong>the</strong> execution <strong>of</strong> <strong>the</strong> sentence, <strong>the</strong> transfer from one<br />

institution <strong>of</strong> one type to ano<strong>the</strong>r <strong>of</strong> a different type.<br />

(4) The court located in <strong>the</strong> place <strong>of</strong> residence <strong>of</strong> <strong>the</strong> convict shall resolve issues related to <strong>the</strong><br />

nullification or extension <strong>of</strong> <strong>the</strong> probation period in case <strong>of</strong> a suspended sentence or <strong>the</strong><br />

nullification <strong>of</strong> a parole.<br />

(5) Resolving <strong>of</strong> issues connected with <strong>the</strong> execution <strong>of</strong> a verdict shall be trailed at <strong>the</strong> Court<br />

session with a prosecutor participation.<br />

Article 365. Release on Parole<br />

(1) Release on parole in cases provided in Article 69 <strong>of</strong> <strong>the</strong> <strong>Criminal</strong> <strong>Code</strong> <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong><br />

<strong>Republic</strong> shall be used by <strong>the</strong> court in <strong>the</strong> location where <strong>the</strong> convict serves <strong>the</strong> sentence<br />

upon <strong>the</strong> petition from <strong>the</strong> body executing <strong>the</strong> sentence. These measures (sanctions) shall<br />

also be applied to those serving <strong>the</strong>ir sentences in military disciplinary (correctional) units<br />

by court as petitioned by <strong>the</strong> Command <strong>of</strong> <strong>the</strong> military correctional unit.<br />

(2) Release on parole <strong>of</strong> persons who have committed <strong>of</strong>fenses under 18 years <strong>of</strong> age shall be<br />

effectuated by court upon a joint petition from <strong>the</strong> body executing <strong>the</strong> sentence and <strong>the</strong><br />

Juvenile Delinquency Commission.<br />

(3) If a parole petition has been rejected, <strong>the</strong> repeated examination <strong>of</strong> <strong>the</strong> same petition shall<br />

take place no earlier <strong>the</strong>n one year after <strong>the</strong> rejection is deduced.
