perform <strong>the</strong> personal search without delay according to <strong>the</strong> rules <strong>of</strong> Article 185 <strong>of</strong> <strong>the</strong> present<br />
<strong>Code</strong>.<br />
Article 97. Grounds for Release <strong>of</strong> <strong>the</strong> Person Detained on <strong>the</strong> Suspicion <strong>of</strong> Committing a<br />
Crime<br />
(1) The detained shall be released by <strong>the</strong> resolution <strong>of</strong> <strong>the</strong> investigator or <strong>the</strong> prosecutor, if:<br />
1) <strong>the</strong> suspicion in committing <strong>the</strong> crime has not been confirmed;<br />
2) <strong>the</strong>re are no grounds or necessity in detaining <strong>the</strong> suspect;<br />
3) period <strong>of</strong> detention established by <strong>the</strong> law has expired.<br />
(2) If within seventy two hours no resolution about <strong>the</strong> sanction <strong>of</strong> custodial placement has not<br />
been received by <strong>the</strong> head <strong>of</strong> detention place <strong>of</strong> deferred, <strong>the</strong> head <strong>of</strong> detention place <strong>of</strong><br />
deferred shall inform <strong>the</strong> prosecutor immediately, where upon, if prosecutor will not apply<br />
<strong>the</strong> sanction in <strong>the</strong> form <strong>of</strong> detention <strong>of</strong> <strong>the</strong> deferred, <strong>the</strong> head <strong>of</strong> <strong>the</strong> detention place <strong>of</strong><br />
deffered shall release him immediately and draw up <strong>the</strong> protocol.<br />
(3) When releasing <strong>the</strong> detained, <strong>the</strong> latter shall receive a reference which indicating by whom he<br />
was detained, <strong>the</strong> ground, <strong>the</strong> place and <strong>the</strong> time <strong>of</strong> detention, as well as <strong>the</strong> grounds and <strong>the</strong><br />
time <strong>of</strong> release.<br />

Article 98. Conditions for Custody <strong>of</strong> <strong>the</strong> Detained on <strong>the</strong> Suspicion <strong>of</strong> Committing a Crime<br />
The detained on <strong>the</strong> suspicion <strong>of</strong> committing a crime shall be placed in <strong>the</strong> temporary<br />
detention center. The procedure for and <strong>the</strong> conditions custody for <strong>the</strong> detained shall be provided<br />
by <strong>the</strong> legislation <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>.<br />
Article 99. Notice <strong>of</strong> <strong>the</strong> suspect’s Relatives <strong>of</strong> his Detention<br />
(1) Within twelve hours <strong>the</strong> investigator shall notify any member <strong>of</strong> <strong>the</strong> family <strong>of</strong> <strong>the</strong> suspect or,<br />
in <strong>the</strong>ir absence, o<strong>the</strong>r relatives or close to him persons about his detention.<br />
(2) If <strong>the</strong> detained is a person <strong>of</strong> ano<strong>the</strong>r state, an embassy or a consulate <strong>of</strong> his state shall be<br />
notified within <strong>the</strong> stated time limit. There shall be a record about <strong>the</strong> notice in <strong>the</strong> case.<br />
Article 100. Interrogation <strong>of</strong> <strong>the</strong> Detained on <strong>the</strong> Suspicion <strong>of</strong> Committing a Crime<br />
(1) A person detained on suspicion <strong>of</strong> committing a crime shall be interrogated as <strong>the</strong> suspect<br />
with participation <strong>of</strong> defense attorney.<br />
(2) Before an interrogation <strong>the</strong> detained shall be explained <strong>the</strong> rights provided by Article 40 <strong>of</strong><br />
this <strong>Code</strong>. He shall be informed what crime he is suspected <strong>of</strong>.<br />
Article 101. Sanctions and Their Types<br />
SECTION 12. SANCTIONS<br />
(1) Sanctions are enforcement measures inflicted on <strong>the</strong> accused in order to prevent his undue<br />
behavior in <strong>the</strong> course <strong>of</strong> <strong>the</strong> criminal case investigation and trial and to provide for an<br />
enforcement <strong>of</strong> <strong>the</strong> sentence.<br />
