The presiding judge shall explain to <strong>the</strong> expert his/her rights and duties provided by Article 63<br />
here<strong>of</strong>, and warns him/ her on criminal liability for providing knowingly false opinion, with<br />
taking a recognizance from him/ her which shall be attached to <strong>the</strong> record <strong>of</strong> <strong>the</strong> hearing.<br />
Article 283. Explanation to Specialist His Rights and Duties<br />
The presiding judge shall explain to <strong>the</strong> specialist his/ her rights and duties provided by Article<br />
65 here<strong>of</strong>, and warned him/ her on <strong>the</strong> liability established by that Article for refusal or<br />
avoidance <strong>of</strong> performing his duties.<br />
Article 284. Filing and Resolution <strong>of</strong> Motions<br />
(1) The presiding judge shall interrogate <strong>the</strong> parties about motions to summon new witnesses,<br />
experts, and specialists to court, and to attach exhibits and documents to <strong>the</strong> case file. A<br />
person who files a motion must indicate, which circumstances will be established by<br />
additional evidence.<br />
(2) The court, after hearing o<strong>the</strong>r participants <strong>of</strong> <strong>the</strong> trial must review any filed motion, grant it,<br />
if circumstances to be established are relevant to <strong>the</strong> case, or make a motivated ruling to<br />
dismiss <strong>the</strong> motion.<br />
(3) A person whose motion was dismissed may file it in <strong>the</strong> future.<br />
Article 285. Resolution <strong>of</strong> an Issue <strong>of</strong> Possible Trial <strong>of</strong> <strong>Criminal</strong> Case in <strong>the</strong> Absence <strong>of</strong> Any<br />
Participating Persons<br />
(1) Should any <strong>of</strong> <strong>the</strong> participants <strong>of</strong> <strong>the</strong> trial, or witness, expert, or specialist fail to appear in<br />
court, <strong>the</strong> court shall hear <strong>the</strong> opinion <strong>of</strong> parties whe<strong>the</strong>r <strong>the</strong> trial <strong>of</strong> <strong>the</strong> case is possible, and<br />
make a decision (resolution) to continue or postpone <strong>the</strong> trial.<br />
(2) Prior to resolution <strong>of</strong> <strong>the</strong> issue on postponement <strong>of</strong> <strong>the</strong> trial, <strong>the</strong> court may interrogate <strong>the</strong><br />
appeared witnesses, expert or specialist, victim, civil plaintiff, civil defendant, and <strong>the</strong>ir<br />
representatives, and <strong>the</strong>n make a decision (resolution) to postpone <strong>the</strong> trial <strong>of</strong> <strong>the</strong> case.<br />
Should <strong>the</strong> case be tried by <strong>the</strong> same panel <strong>of</strong> judges, <strong>the</strong> second summoning <strong>of</strong> interrogated<br />
persons to court is allowed only if necessary.<br />
Article 286. Commencement <strong>of</strong> Court Trial<br />
CHAPTER 35. COURT TRIAL<br />
(1) The court trial shall commence with statement <strong>of</strong> <strong>the</strong> substance <strong>of</strong> <strong>the</strong> charge brought against<br />
<strong>the</strong> defendant, and in instances <strong>of</strong> personal charge—with statement <strong>of</strong> <strong>the</strong> petition by a<br />
person who filed this petition with <strong>the</strong> court, or his/ her representative.<br />
(2) The presiding judge interrogates <strong>the</strong> defendant, whe<strong>the</strong>r he understands <strong>the</strong> charge, and in<br />
necessary cases explains to him/ her <strong>the</strong> essence <strong>of</strong> <strong>the</strong> charge, and finds out, whe<strong>the</strong>r he is<br />
willing to express to <strong>the</strong> court his/ her attitude to this charge.<br />
Article 287. Establishing <strong>Procedure</strong> for Examination <strong>of</strong> Evidence
