Should <strong>the</strong> verdict be amended, such amendments must be stipulated and certified by<br />
signatures <strong>of</strong> all judges in <strong>the</strong> conference room, prior to <strong>the</strong> announcement <strong>of</strong> <strong>the</strong> agreement.<br />
(3) The verdict <strong>of</strong> <strong>the</strong> members <strong>of</strong> composition <strong>of</strong> <strong>the</strong> court could be written by <strong>the</strong> judge or one<br />
<strong>of</strong> <strong>the</strong> associate judges, who participated in its rendering. The verdict shall be signed by <strong>the</strong><br />
judge and associate judges. The judge or associate judge, who has a special opinion, also has<br />
to sign <strong>the</strong> verdict without any proviso.<br />

Article 318. Introduction<br />
Introduction <strong>of</strong> <strong>the</strong> sentence shall indicate:<br />
(1) that <strong>the</strong> verdict is rendered in <strong>the</strong> name <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>;<br />
(2) <strong>the</strong> time and place <strong>of</strong> rendering <strong>the</strong> verdict;<br />
(3) <strong>the</strong> name <strong>of</strong> <strong>the</strong> court that rendered <strong>the</strong> verdict, name, patronymic, family name <strong>of</strong> presiding<br />
judge, associate judges, clerk <strong>of</strong> <strong>the</strong> court, accuser, defense attorney, victim, legal<br />
representative, civil plaintiff, civil defendant;<br />
(4) <strong>the</strong> given name, patronymic, and family name <strong>of</strong> <strong>the</strong> defendant, <strong>the</strong> year, month and day <strong>of</strong><br />
his/ her birth, place <strong>of</strong> residence, place <strong>of</strong> work, occupation, education, family state, and<br />
o<strong>the</strong>r data on <strong>the</strong> identity <strong>of</strong> <strong>the</strong> defendant relevant to <strong>the</strong> case.<br />
(5) <strong>the</strong> criminal law, which envisages <strong>the</strong> crime <strong>of</strong> which <strong>the</strong> defendant is charged.<br />

Article 319. Description and Motivation in Guilty Verdict<br />
(1) The description and motivation in guilty verdict must contain <strong>the</strong> description <strong>of</strong> <strong>the</strong> criminal<br />
act, which is deemed proven by court, with indication <strong>of</strong> <strong>the</strong> place, time, method <strong>of</strong> its<br />
commission, <strong>the</strong> form <strong>of</strong> guilt, motives, goals and <strong>the</strong> consequences <strong>of</strong> <strong>the</strong> crime. The verdict<br />
shall also include <strong>the</strong> evidence, on which <strong>the</strong> opinion <strong>of</strong> <strong>the</strong> court is based in respect tot he<br />
defendant and <strong>the</strong> motives based on which o<strong>the</strong>r evidence were dismissed by <strong>the</strong> court.<br />
Mitigating and aggravating circumstances shall be also specified, and should any part <strong>of</strong> <strong>the</strong><br />
charge be deemed non-substantiated, or a wrong qualification <strong>of</strong> <strong>the</strong> crime be established—<br />
grounds and motives for alteration <strong>of</strong> <strong>the</strong> charge.<br />
(2) The court must also give <strong>the</strong> motives for resolution <strong>of</strong> all issues relevant to assigning a<br />
criminal punishment, relieve from <strong>the</strong> punishment, or actual serving <strong>the</strong>re<strong>of</strong>, or applying<br />
o<strong>the</strong>r measures <strong>of</strong> pressure.<br />
(3) The description and motivation must also contain <strong>the</strong> substantiation fro adopted decisions on<br />
issues specified in Article 312 here<strong>of</strong>.<br />

Article 320. Resolution in Guilty Verdict<br />
(1) The resolution <strong>of</strong> <strong>the</strong> guilty verdict must indicate:<br />
1) family name, full name and patronymic <strong>of</strong> <strong>the</strong> defendant;<br />
2) decision on finding <strong>the</strong> defendant guilty <strong>of</strong> commission <strong>of</strong> <strong>the</strong> crime<br />
3) article <strong>of</strong> <strong>the</strong> criminal law based on which <strong>the</strong> defendant was found guilty.
