Article 159. Institution <strong>of</strong> Prosecution <strong>of</strong> Personal-and-Public Charge<br />

(1) Personal-and-Public prosecution shall be instituted only upon a victim’s report. Any<br />

investigation and court proceedings shall be enforced according to <strong>the</strong> general procedure.<br />

(2) Any prosecutor shall be authorized on his own initiative to institute personal-and-public<br />

prosecution only in <strong>the</strong> following cases:<br />

1) if an action damages <strong>the</strong> interests <strong>of</strong> <strong>the</strong> public and <strong>the</strong> state;<br />

2) if an action damages <strong>the</strong> interests <strong>of</strong> a person who is helpless or dependent or because <strong>of</strong><br />

some o<strong>the</strong>r reasons may not individually realize belonging to him rights.<br />

(3) A copy <strong>of</strong> <strong>the</strong> investigator’s resolution on institution <strong>of</strong> prosecution shall be filed with a<br />

prosecutor within 24 hours.<br />

Article 160. Direction <strong>of</strong> prosecution after its initiation<br />

After <strong>the</strong> resolution on institution <strong>of</strong> prosecution has been rendered:<br />

(1) The investigator shall start investigation or transfer <strong>the</strong> case to a prosecutor to be fur<strong>the</strong>r sent<br />

to <strong>the</strong> appropriate jurisdiction;<br />

(2) A prosecutor shall send a case to an investigator to carry out <strong>the</strong> investigation.<br />

SECTION 21. GENERAL INVESTIGATION CONDITIONS<br />

Article 161. Investigation Agencies<br />

Investigation <strong>of</strong> criminal cases shall be enforced in accordance with <strong>the</strong> determined by this <strong>Code</strong><br />

procedure by investigators <strong>of</strong> agencies <strong>of</strong> procuracy, agencies <strong>of</strong> <strong>the</strong> Ministry <strong>of</strong> Internal Affairs,<br />

National Security agencies, <strong>the</strong> agency <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong> on drug control <strong>of</strong> criminalprocedural<br />

system <strong>of</strong> Ministry <strong>of</strong> Justice <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>, financial police and tax police<br />

agencies.<br />

Article 162. Obligatoriness <strong>of</strong> investigation<br />

(1) Investigation shall be obligatory for all criminal cases with <strong>the</strong> exception for cases initiated<br />

on private charge.<br />

(2) Investigation shall be obligatory for all criminal cases when a crime was committed by a<br />

juvenile or a person who due to being disabled physically or mentally can not realize his right<br />

to defense.<br />

Article 163. Jurisdiction<br />

(1) <strong>Criminal</strong> cases about crimes against life and health (Articles 97 – 109, 111, part one <strong>of</strong><br />

Article 112, Articles 113-122 <strong>of</strong> <strong>the</strong> <strong>Criminal</strong> <strong>Code</strong> <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>), about crimes<br />

against freedom, honor and dignity <strong>of</strong> a person (Articles 123 – 125, part two <strong>of</strong> Article 126 <strong>of</strong><br />

<strong>the</strong> <strong>Criminal</strong> <strong>Code</strong> <strong>of</strong> <strong>the</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>), about crimes against inviolability <strong>of</strong> sex and
