Article 167. Investigation Enforced by a Group <strong>of</strong> Investigators<br />
(1) Investigation <strong>of</strong> a criminal case when being complicated or because <strong>of</strong> its big volume may be<br />
given to a group <strong>of</strong> investigators (investigation group) and that shall be specified in a<br />
separate resolution on institution <strong>of</strong> prosecution or a special resolution shall be rendered. The<br />
resolution shall specify all investigators who were authorized to carry out investigation<br />
including <strong>the</strong> investigator being a group leader who accepts <strong>the</strong> case in his proceedings and<br />
supervises actions <strong>of</strong> o<strong>the</strong>r investigators.<br />
(2) Any suspect, accused, victim, civil plaintiff and defendant and <strong>the</strong>ir representatives shall be<br />
notified with <strong>the</strong> resolution on case investigation with a group <strong>of</strong> investigators and <strong>the</strong>y shall<br />
be explained <strong>the</strong> right to challenge any investigator <strong>of</strong> a group.<br />
Article 168. Investigation Group Leader Authority<br />
(1) Investigator—leader <strong>of</strong> an investigation group shall accept a criminal case in his proceedings,<br />
carry out <strong>the</strong> investigation personally, utilizing <strong>the</strong> authorities <strong>of</strong> an investigator, organize <strong>the</strong><br />
work <strong>of</strong> an investigation group, make decisions on <strong>the</strong> case.<br />
(2) Decisions on joining and apportionment <strong>of</strong> cases, initiation <strong>of</strong> motions on extension <strong>of</strong> an<br />
investigation time limit, enforcement <strong>of</strong> such sanction as taking into custody and its<br />
extension, suspension and recommencement <strong>of</strong> a case shall be taken only by <strong>the</strong> leader <strong>of</strong> <strong>the</strong><br />
investigation group.<br />
(3) Resolution on charge and resolution on filing a case with court shall be compiled by <strong>the</strong><br />
leader <strong>of</strong> an investigation group.<br />
Article 169. General Rules <strong>of</strong> Investigatory Actions Enforcement<br />
(1) Any investigator initiating investigatory actions provided by law shall check identification <strong>of</strong><br />
<strong>the</strong> participants <strong>of</strong> investigatory actions, explain <strong>the</strong>m <strong>the</strong>ir rights and responsibilities as well<br />
as <strong>the</strong> procedure <strong>of</strong> <strong>the</strong> investigatory action.<br />
(2) Enforcement <strong>of</strong> <strong>the</strong> investigatory action at night shall be prohibited with <strong>the</strong> exception for<br />
cases <strong>of</strong> no delay.<br />
(3) While enforcing investigatory actions, technical facilities and scientifically proved methods<br />
or discoveries for fixing and taking vestiges <strong>of</strong> a crime and material evidence may be applied.<br />
(4) While enforcing investigatory actions, violence, threats and o<strong>the</strong>r illegal actions as well as<br />
causing threat to <strong>the</strong> life and health <strong>of</strong> participating in such proceedings persons shall be<br />
prohibited.<br />
Article 170. Transcript <strong>of</strong> Investigatory Proceedings<br />
(1) Transcript <strong>of</strong> investigatory proceedings shall be compiled in <strong>the</strong> course <strong>of</strong> <strong>the</strong> investigatory<br />
proceedings or right after its completion.<br />
(2) The transcript <strong>of</strong> proceedings may be written by hand or typed on a typing machine or a<br />
