in it. The presiding judge shall be <strong>the</strong> last to vote. The decision <strong>of</strong> court <strong>of</strong> cassational<br />
jurisdiction shall be considered as accepted if <strong>the</strong> majority <strong>of</strong> <strong>the</strong> judges will vote for it.<br />
(12) On <strong>the</strong> session <strong>of</strong> <strong>the</strong> court <strong>of</strong> cassational jurisdiction <strong>the</strong> minutes shall be kept, which shall<br />
be signed by presiding judge and <strong>the</strong> clerk <strong>of</strong> <strong>the</strong> court.<br />
(13) The regulations <strong>of</strong> <strong>the</strong> court session and measures taken in respect to disturbers are<br />
determined by <strong>the</strong> rules provided in Articles 269, 271 here<strong>of</strong>.<br />
(14) The review <strong>of</strong> <strong>the</strong> conviction, ruling, resolution <strong>of</strong> <strong>the</strong> court, which leads to worsening <strong>the</strong><br />
situation <strong>of</strong> <strong>the</strong> convicted, as well as reviewing <strong>the</strong> verdict as “non-guilty” or ruling,<br />
resolution <strong>of</strong> <strong>the</strong> court on dismissal <strong>of</strong> case, shall be allowed within one year after it has<br />
become res judicata.<br />
Article 373-6. Decision <strong>of</strong> <strong>the</strong> Court <strong>of</strong> Cassational Jurisdiction<br />
(1) The court <strong>of</strong> cassational jurisdiction shall render one <strong>of</strong> <strong>the</strong> following decisions based on <strong>the</strong><br />
results <strong>of</strong> consideration <strong>of</strong> <strong>the</strong> criminal case in cassational order:<br />
1) verdict to leaving <strong>the</strong> verdict that was complained in force;<br />
2) verdict to alter <strong>the</strong> verdict that was complained;<br />
3) verdict to repeal <strong>the</strong> verdict that was complained and to dismiss <strong>the</strong> criminal case;<br />
4) verdict to repeal <strong>the</strong> verdict that was complained and to file <strong>the</strong> case to <strong>the</strong> court<br />
<strong>of</strong> original jurisdiction for <strong>the</strong> new trial or to send <strong>the</strong> case to <strong>the</strong> prosecutor for<br />
additional investigation on gaps, which were not investigated in <strong>the</strong> court;<br />
5) verdict to dismiss <strong>the</strong> cassational proceeding on <strong>the</strong> basis <strong>of</strong> part fourteen <strong>of</strong><br />
Article 373-5 here<strong>of</strong>.<br />
(2) The decision <strong>of</strong> <strong>the</strong> court <strong>of</strong> cassational jurisdiction shall be rendered in <strong>the</strong> form <strong>of</strong> ruling.<br />
(3) The decision <strong>of</strong> <strong>the</strong> court <strong>of</strong> cassational jurisdiction shall be compiled in <strong>the</strong> conference room<br />
and shall be signed by all three judges that participated in considering <strong>the</strong> criminal case. In<br />
exceptional cases on particularly complicated case <strong>the</strong> compilation <strong>of</strong> <strong>the</strong> valid decision may<br />
be postponed on <strong>the</strong> term <strong>of</strong> no more than ten days, but <strong>the</strong> resolution part shall be compiled<br />
and signed by <strong>the</strong> judges in <strong>the</strong> conference room.<br />
(4) The decision shall be announced by <strong>the</strong> presiding judge or reporting judge. All persons that<br />
are present in <strong>the</strong> court room shall rise when hearing <strong>the</strong> decision.<br />
(5) The decision <strong>of</strong> <strong>the</strong> court <strong>of</strong> cassational jurisdiction may be appealed in order <strong>of</strong> reviewing<br />
res judicata cases into <strong>the</strong> Supreme Court <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>.<br />
Article 373-7. The Execution <strong>of</strong> <strong>the</strong> Decisions <strong>of</strong> <strong>the</strong> Court <strong>of</strong> Cassational Jurisdiction<br />
The decision <strong>of</strong> <strong>the</strong> court <strong>of</strong> cassational jurisdiction enters into legal force immediately and shall<br />
be executed in order provided herein and in <strong>Criminal</strong>-Executive <strong>Code</strong> <strong>of</strong> <strong>Kyrgyz</strong> <strong>Republic</strong>.<br />
