(4) Releasing on parole, <strong>the</strong> court shall have <strong>the</strong> right to impose certain obligations upon <strong>the</strong><br />
convict: not to change <strong>the</strong> place <strong>of</strong> permanent residence, to abstain from visiting certain<br />
places, as well as o<strong>the</strong>r obligations that are to facilitate his/her correction.<br />
(5) The bodies <strong>of</strong> <strong>the</strong> law enforcement agencies, and in respect <strong>of</strong> <strong>the</strong> military—<strong>the</strong> Command<br />
<strong>of</strong> military units and institution, shall watch <strong>the</strong> conduct <strong>of</strong> those let on parole.<br />
(6) If <strong>the</strong> paroled convict has committed an <strong>of</strong>fense disturbing <strong>the</strong> public order and, <strong>the</strong>refore,<br />
an administrative penalty has been imposed on him/her, or repeatedly has avoided <strong>the</strong><br />
obligations inferred on him/her by court during <strong>the</strong> unserved portion <strong>of</strong> his/her sentence, <strong>the</strong><br />
court shall resolve to recall <strong>the</strong> parole and order to serve out <strong>the</strong> remained portion <strong>of</strong> <strong>the</strong><br />
sentence upon a petition filed by <strong>the</strong> body specified in paragraph 5 <strong>of</strong> this article.<br />
(7) If <strong>the</strong> convict commits a now crime during <strong>the</strong> unserved portion <strong>of</strong> <strong>the</strong> sentence, <strong>the</strong> court<br />
shall pass a sentence upon <strong>the</strong> convict based on <strong>the</strong> strength <strong>of</strong> all verdicts.<br />
Article 366. Nullification <strong>of</strong> a Conditional Conviction and Extension <strong>of</strong> a Probation<br />
(1) If prior to <strong>the</strong> expiration <strong>of</strong> a probation period <strong>the</strong> conditionally convicted has proven his/her<br />
correction, <strong>the</strong> court may recall <strong>the</strong> conditional conviction upon <strong>the</strong> petition by <strong>the</strong> body<br />
reviewing <strong>the</strong> conduct <strong>of</strong> <strong>the</strong> conditionally convicted.<br />
(2) If <strong>the</strong> conditionally convicted avoids performing <strong>the</strong> obligations imposed upon him/her by<br />
court or commits a disturbance <strong>of</strong> <strong>the</strong> public order for which an administrative sanction is<br />
imposed upon him/her, <strong>the</strong> court may extend <strong>the</strong> probation period up to one year upon <strong>the</strong><br />
petition filed by <strong>the</strong> body specified in paragraph 1 <strong>of</strong> this article.<br />
(3) In case <strong>the</strong> conditionally convicted systematically fails to perform <strong>the</strong> obligations imposed<br />
upon him/her by court during <strong>the</strong> probation, <strong>the</strong> court shall resolve to recall <strong>the</strong> conditional<br />
conviction and to execute <strong>the</strong> deduced verdict upon <strong>the</strong> petition by <strong>the</strong> body specified in<br />
paragraph 1 <strong>of</strong> this article.<br />
(4) If <strong>the</strong> conditionally convicted commits a new intentional <strong>of</strong>fense during <strong>the</strong> probation<br />
period, <strong>the</strong> court shall pass a verdict on him/her on <strong>the</strong> strength <strong>of</strong> all <strong>of</strong>fenses.<br />
Article 367. Replacement <strong>of</strong> <strong>the</strong> Unserved Portion <strong>of</strong> a Sentence with a Less Severe Penalty<br />
The court may replace <strong>the</strong> unserved portion <strong>of</strong> a sentence with a less severe penalty for a person<br />
who is imprisoned with due consideration given to his/her conduct while in jail.<br />
Article 368. Cessation <strong>of</strong> <strong>the</strong> Compulsory Medical Measure<br />
The cessation <strong>of</strong> a compulsory medical measure joined with <strong>the</strong> execution <strong>of</strong> <strong>the</strong> verdict shall be<br />
effectuated by <strong>the</strong> court upon <strong>the</strong> petition <strong>of</strong> <strong>the</strong> body enforcing <strong>the</strong> judgment based on <strong>the</strong><br />
evaluation statement <strong>of</strong> a Medical Commission.<br />
Article 369. Computation <strong>of</strong> Time <strong>of</strong> a Sojourn at a Medical Institution into <strong>the</strong> Term <strong>of</strong><br />
Imprisonment<br />
If a person sentenced to imprisonment is placed at a medical institution, <strong>the</strong> time spent <strong>the</strong>re by<br />
<strong>the</strong> convict shall be computed into <strong>the</strong> term <strong>of</strong> imprisonment.
