(2) During interrogation <strong>of</strong> <strong>the</strong> minor suspect, accused <strong>the</strong> defense attorney, whose participation<br />

is mandatory pursuant to Article 46 <strong>of</strong> this <strong>Code</strong>, shall have <strong>the</strong> right to ask questions to <strong>the</strong><br />

questioned, and upon <strong>the</strong> end <strong>of</strong> <strong>the</strong> interrogation—to look through <strong>the</strong> protocol and<br />

comment on correctness and completeness <strong>the</strong> testimony records.<br />

Article 396. Participation <strong>of</strong> a Teacher and Psychologist.<br />

(1) Participation <strong>of</strong> a teacher and psychologist shall be mandatory in <strong>the</strong> interrogation <strong>of</strong> a minor<br />

suspect, accused under <strong>the</strong> age <strong>of</strong> sixteen, as well as those who have reached this age,<br />

however, recognized mentally retarded. The teacher or psychologist takes part in <strong>the</strong><br />

interrogation <strong>of</strong> a minor suspect, accused who is over <strong>the</strong> age <strong>of</strong> sixteen according to <strong>the</strong><br />

discretion <strong>of</strong> <strong>the</strong> investigator, prosecutor or according to <strong>the</strong> petition <strong>of</strong> a defense attorney.<br />

(2) A teacher or psychologist shall have <strong>the</strong> right to ask questions to <strong>the</strong> suspect, accused upon<br />

<strong>the</strong> permission <strong>of</strong> <strong>the</strong> investigator, and upon <strong>the</strong> end <strong>of</strong> <strong>the</strong> interrogation—to look through <strong>the</strong><br />

protocol and comment on <strong>the</strong> correctness and completeness <strong>of</strong> <strong>the</strong> testimony records. These<br />

rights shall be explained by <strong>the</strong> investigator to <strong>the</strong> teacher or psychologist prior to<br />

interrogation <strong>of</strong> a minor <strong>of</strong> which is an appropriate note is entered in <strong>the</strong> protocol <strong>of</strong> <strong>the</strong><br />

interrogation.<br />

(3) Participation <strong>of</strong> a teacher or psychologist in <strong>the</strong> interrogation <strong>of</strong> a minor suspect in court<br />

shall be effectuated by <strong>the</strong> rules <strong>of</strong> Sections I and II <strong>of</strong> this <strong>Code</strong>.<br />

Article 397. Participation <strong>of</strong> <strong>the</strong> Legal Representative <strong>of</strong> a Minor Suspect, Accused in <strong>the</strong><br />

Investigation.<br />

(1) A legal representative <strong>of</strong> a suspect or accused shall participate in <strong>the</strong> investigation and court<br />

proceeding <strong>of</strong> cases on crimes committed by minors.<br />

(2) A legal representative shall be allowed to participate in <strong>the</strong> case by <strong>the</strong> resolution <strong>of</strong> <strong>the</strong><br />

investigator from <strong>the</strong> moment <strong>of</strong> <strong>the</strong> first interrogation <strong>of</strong> a minor as <strong>the</strong> suspect or accused.<br />

The legal representative shall be provided with an explanation <strong>of</strong> his rights mentioned in <strong>the</strong><br />

third paragraph <strong>of</strong> this article.<br />

(3) A legal representative shall have <strong>the</strong> right: to know what a minor is suspected or accused <strong>of</strong>,<br />

to be present during <strong>the</strong> brining <strong>of</strong> an accusation, to participate in <strong>the</strong> interrogation <strong>of</strong> a<br />

minor, as well as in o<strong>the</strong>r investigation actions carried out with <strong>the</strong> participation <strong>of</strong> a minor<br />

suspect or accused, and his/her defense attorney; to look through protocols <strong>of</strong> investigation<br />

actions in which he/she has participated, and make written notes <strong>of</strong> <strong>the</strong> correctness and<br />

completeness <strong>of</strong> records <strong>the</strong>rein; to file petitions and challenges, submit petitions on actions<br />

and decisions <strong>of</strong> <strong>the</strong> investigator or prosecutor; to present evidence; upon <strong>the</strong> end <strong>of</strong> <strong>the</strong><br />

investigation—to get familiarized with all materials <strong>of</strong> <strong>the</strong> case, to extract any information in<br />

any volume <strong>the</strong>refrom.<br />

(4) A legal representative may be debarred from <strong>the</strong> participation in <strong>the</strong> case if <strong>the</strong>re are grounds<br />

to recognize his/her actions as bringing damage on <strong>the</strong> interests <strong>of</strong> a minor or as intended to<br />

hamper <strong>the</strong> fair investigation <strong>of</strong> <strong>the</strong> case. The investigator shall issue a grounded resolution<br />

on this. Ano<strong>the</strong>r legal representative <strong>of</strong> a minor may be allowed to participate in <strong>the</strong> case.<br />

Article 398. Participation <strong>of</strong> a Legal Representative <strong>of</strong> <strong>the</strong> Minor Accused in <strong>the</strong> Court<br />
