(2) The judge may issue a resolution to suspend <strong>the</strong> proceedings in <strong>the</strong> case.<br />
(3) In suspending <strong>the</strong> case on <strong>the</strong> ground provided in part 1 <strong>of</strong> this Article <strong>the</strong> case is referred to<br />
Prosecutor except <strong>the</strong> case provided in part 2 <strong>of</strong> Article 259 <strong>of</strong> this <strong>Code</strong>.<br />

Article 247. Setting Trial<br />
(1) A judge, when making a conclusion that all requirements <strong>of</strong> this <strong>Code</strong> aimed at ensurance <strong>of</strong><br />
<strong>the</strong> rights <strong>of</strong> <strong>the</strong> individual were observed and <strong>the</strong>re are no o<strong>the</strong>r grounds which impede <strong>the</strong><br />
trial <strong>of</strong> <strong>the</strong> case in court, shall make a decision to set a court trial.<br />
(2) The resolution setting <strong>the</strong> trial, shall include <strong>the</strong> following issues, besides those indicated in<br />
Article 244, 245 <strong>of</strong> this <strong>Code</strong>:<br />
1) place and time <strong>of</strong> court trial;<br />
2) summoning participants <strong>of</strong> <strong>the</strong> trial to court;<br />
3) hearing a case in a close court session, in instances provided by Article 22 and parts 1, 2,<br />
3 and 4 <strong>of</strong> Article 254 here<strong>of</strong>.<br />
(3) Along with issues indicated in part 2 <strong>of</strong> this Article, <strong>the</strong> resolution must also include<br />
decisions to set a trial, sanctions in relation to a person charged in <strong>the</strong> case, his/ her identity<br />
and qualification <strong>of</strong> a crime incriminated to him/ her<br />
(4) The parties shall be informed on <strong>the</strong> date and time <strong>of</strong> <strong>the</strong> trial within no less than 10 days to<br />
<strong>the</strong> settled date.<br />
Article 248. Measures to Ensure Civil Lawsuit Including Confiscation <strong>of</strong> Property<br />
Should <strong>the</strong> investigator fail to take measures ensuring <strong>the</strong> indemnification <strong>of</strong> <strong>the</strong> harm inflicted<br />
by <strong>the</strong> crime and possible confiscation <strong>of</strong> <strong>the</strong> property, <strong>the</strong> judge obligates <strong>the</strong> bodies <strong>of</strong><br />
investigation to take necessary measures to secure <strong>the</strong> lawsuit.<br />
Article 249. Discontinuing Proceedings<br />
(1) A judge makes a resolution to discontinue <strong>the</strong> proceedings on <strong>the</strong> grounds indicated in<br />
Article 28 here<strong>of</strong>. After making a decision to discontinuing <strong>the</strong> proceedings, <strong>the</strong> judge<br />
dismisses <strong>the</strong> sanction, measures <strong>of</strong> securing a civil lawsuit, and confiscation <strong>of</strong> property, and<br />
resolves an issue on exhibits. A copy <strong>of</strong> <strong>the</strong> resolution <strong>of</strong> a judge to discontinue <strong>the</strong><br />
proceedings shall be sent to <strong>the</strong> prosecutor, and served to a person who was brought to<br />
criminal liability, and to <strong>the</strong> victim.<br />
(2) The question on discontinuing <strong>the</strong> proceedings shall be allowed by <strong>the</strong> judge (court) in court<br />
session with participation <strong>of</strong> prosecutor, victim, accused, defense attorney, legal<br />
representative, civil plaintiff, civil defendant. Default <strong>of</strong> any trial participant shall not be an<br />
obstacle <strong>of</strong> conducting a trial. Discontinuing <strong>the</strong> proceedings on <strong>the</strong> basis, stated in points 10<br />
and 11 <strong>of</strong> part one Article 28 here<strong>of</strong>, shall be allowed only if <strong>the</strong> accused will agree. The<br />
question on validity <strong>of</strong> guiltiness <strong>of</strong> accused shall not be discussed in <strong>the</strong> court session, <strong>the</strong><br />
evidence shall not be examined.<br />
(3) The chairman shall inform <strong>the</strong> appeared persons on <strong>the</strong> aim <strong>of</strong> conducting <strong>the</strong> court session.<br />
