1) make sure requirements <strong>of</strong> <strong>the</strong> law are followed during registration and processing <strong>of</strong><br />
reports on committed or preparing crimes;<br />
2) charge an investigator or a group <strong>of</strong> investigators with <strong>the</strong> investigation <strong>of</strong> a criminal<br />
case;<br />
3) approve a rejection <strong>of</strong> an investigator and his rejection <strong>of</strong> his nomination;<br />
4) give orders in writing to an investigator concerning <strong>the</strong> investigation <strong>of</strong> a case, choice,<br />
change, and repeal <strong>of</strong> sanctions, qualification <strong>of</strong> an <strong>of</strong>fense, and performing<br />
investigational and o<strong>the</strong>r proceedings;<br />
5) consider objections <strong>of</strong> an investigator as provided herein when <strong>the</strong> investigator disagrees<br />
with orders <strong>of</strong> <strong>the</strong> prosecutor provided that <strong>the</strong> prosecutor carries out <strong>the</strong> prosecutorial<br />
review;<br />
6) repeal illegal and ungrounded resolutions <strong>of</strong> an investigator and lower-rank prosecutor,<br />
make resolutions for adjournment, dismissal <strong>of</strong> proceedings for <strong>the</strong> case;<br />
7) consider complaints and petitions from decisions and actions <strong>of</strong> <strong>the</strong> agency <strong>of</strong> preliminary<br />
investigation, <strong>of</strong> <strong>the</strong> investigator and lower-rank prosecutor;<br />
8) discharge <strong>the</strong> investigator and lower-rank prosecutor from fur<strong>the</strong>r participation in<br />
criminal proceedings on <strong>the</strong> case provided that <strong>the</strong>y violated <strong>the</strong> law;<br />
9) address pertinent agencies with petitions to deprive <strong>the</strong> immunity persons enjoying <strong>the</strong><br />
right <strong>of</strong> immunity provided that criminal proceedings should be instituted against <strong>the</strong>m;<br />
10) represent prosecution in court;<br />
11) return cases to <strong>the</strong> investigator for additional investigation on <strong>the</strong> gaps in <strong>the</strong> case;<br />
12) dismiss <strong>the</strong> criminal case against <strong>the</strong> defendant and change <strong>the</strong> charge;<br />
13) give orders in writing to <strong>the</strong> agency <strong>of</strong> preliminary investigation concerning detection and<br />
search necessary for <strong>the</strong> criminal case;<br />
14) give orders concerning protection <strong>of</strong> <strong>the</strong> victim, witness and o<strong>the</strong>r participants <strong>of</strong> <strong>the</strong><br />
criminal proceedings;<br />
15) release illegally arrested persons from custody;<br />
16) extend <strong>the</strong> period for investigation and <strong>the</strong> period <strong>of</strong> arrest for <strong>the</strong> defendant;<br />
(3) Prosecutor shall be charged with o<strong>the</strong>r authorities as provided herein.<br />
(4) Orders <strong>of</strong> <strong>the</strong> prosecutor to <strong>the</strong> agencies <strong>of</strong> preliminary investigation and investigation<br />
concerning <strong>the</strong> institution <strong>of</strong> criminal proceedings and investigation <strong>of</strong> criminal cases shall be<br />
binding for <strong>the</strong> latter provided that <strong>the</strong> orders were given in accordance with <strong>the</strong> procedure<br />
provided herein. Appeal <strong>of</strong> such orders to a higher-rank prosecutor shall not suspend <strong>the</strong>ir<br />
execution.<br />

Article 35. Investigator<br />
(1) An investigator is a state <strong>of</strong>ficial who, within his authorities, performs investigation <strong>of</strong><br />
criminal cases.<br />
(2) Investigator initiates prosecution, investigates <strong>the</strong> case and carries out all investigational<br />
proceedings provided herein.<br />
(3) Investigator shall personally decide on issues <strong>of</strong> investigation and actions <strong>of</strong> investigation<br />
except those cases when, in accordance with <strong>the</strong> law, an action shall be authorized by<br />
prosecutor. The investigator shall be totally responsible for <strong>the</strong> legality <strong>of</strong> such actions and<br />
for <strong>the</strong>ir timely fulfillment.
