the draft<strong>in</strong>g of an <strong>in</strong>ternational <strong>in</strong>strument on the subject, the pillars and<br />
guidel<strong>in</strong>es of which were submitted to, and adopted by, the Sixty-fi fth ILA<br />
Conference, held <strong>in</strong> Cairo <strong>in</strong> 1992. <strong>The</strong> follow<strong>in</strong>g should be highlighted:<br />
a general obligation to cooperate;<br />
an obligation to negotiate <strong>in</strong> good faith;<br />
an obligation to ensure that space activities cause no harm to<br />
persons, objects or the environment of other states, or to the<br />
environment <strong>in</strong> areas beyond national jurisdiction;<br />
an obligation to <strong>in</strong>form and exchange <strong>in</strong>formation, to consult, to<br />
prevent, control and reduce contam<strong>in</strong>ation, pollution and space<br />
debris, as well as <strong>in</strong>active satellites preclud<strong>in</strong>g the use of orbital<br />
facilities by active systems; and<br />
an obligation to make every effort to settle disputes promptly and<br />
<strong>in</strong> an amicable manner, by peaceful means, with special accent on<br />
the need to avoid situations which may lead to disputes.<br />
Some brief comments and recommendations concern<strong>in</strong>g those pillars,<br />
designed for space debris mitigation at the time, follow: 12<br />
<strong>in</strong> the fi rst place, for draft<strong>in</strong>g an <strong>in</strong>ternational <strong>in</strong>strument on the<br />
matter, it was essential to agree on some defi nition or description of<br />
what should be understood by contam<strong>in</strong>ation, pollution and space<br />
debris and establish the scope and implications of the proposed<br />
<strong>in</strong>strument <strong>in</strong> the widest possible terms;<br />
the general obligation to cooperate (fi rst pillar) should be <strong>in</strong>terpreted<br />
broadly, <strong>in</strong> a way consistent with the 1989 Ottawa Declaration of<br />
the Meet<strong>in</strong>g of Experts on the Protection of the Atmosphere; 13<br />
the obligation to negotiate <strong>in</strong> good faith should be <strong>in</strong>terpreted as<br />
one where talks are conducted with the ma<strong>in</strong> target of reach<strong>in</strong>g<br />
effective solutions and where any unjustifi ed break<strong>in</strong>g-off of<br />
negotiations is seen as bad faith;<br />
the obligation to exchange <strong>in</strong>formation should be equally<br />
<strong>in</strong>terpreted as one to <strong>in</strong>form <strong>in</strong> cases where a given activity of<br />
uncerta<strong>in</strong> consequences is to be carried out;<br />
the obligation to consult should be b<strong>in</strong>d<strong>in</strong>g upon states and refusal<br />
to hold consultations should be seen as bad faith;<br />
dispute settlement is a key issue for the effectiveness of the rules<br />
embodied <strong>in</strong> the proposed <strong>in</strong>strument. <strong>The</strong> draft should <strong>in</strong>clude an<br />
optional clause on dispute settlement to allow states to waive the
