Article 80 Process and Filings<br />
This DPIR is being submitted under Article 80 of the <strong>Boston</strong> Zoning Code (the<br />
“Code”) pursuant to the Scoping Determination issued by the Director of the BRA on<br />
February 15, 2008 in order to provide more detailed <strong>Project</strong> information, present the<br />
results of additional requested studies and respond to comments received from<br />
governmental agencies, PruPAC and members of the community on the August 27,<br />
2007 NPC/PNF. The current filing seeks review under the provisions of Section 80A-<br />
6 (Notice of <strong>Project</strong> Change) and Section 80B-5 (Large <strong>Project</strong> Review).<br />
Contemporaneously with the filing of this DPIR, a Fourth Amendment to the<br />
Development Plan is being submitted to the BRA for review under Article 80C-7.<br />
This Fourth Amendment to the Development Plan will seek approval of Phase 6 on a<br />
Development Plan level, previously approved in 2002 on a Master Plan level;<br />
approval of a modification of Phase 4a, previously approved in the 1990<br />
Development Plan for PDA No. 37; and approval of a modification of Phase 4b,<br />
previously approved in 2002 on a Master Plan level.<br />
Phase 4a, including the previously approved Boylston Office Building, was described<br />
in the Prudential Center <strong>Redevelopment</strong> Planned Development Area Final <strong>Project</strong><br />
<strong>Impact</strong> <strong>Report</strong>/Environmental <strong>Impact</strong> <strong>Report</strong> (Prudential FPIR/FEIR) prepared in<br />
connection with the original adoption of the 1990 Development Plan (Prudential<br />
Center <strong>Redevelopment</strong>, Final <strong>Project</strong> and Environmental <strong>Impact</strong> <strong>Report</strong>, EOEA §7208<br />
submitted November 13, 1989, by The Prudential Property Company, Inc. for the<br />
Prudential Insurance Company of America. The BRA Final Adequacy Determination<br />
was issued on April 27, 1990). The 888 Boylston site occupies a portion of the areas<br />
designated for construction under Phase 4a, some of which was constructed between<br />
1990 and 1993. Phase 6, including Exeter Residences, has not previously been subject<br />
to Large <strong>Project</strong> Review under Article 80B. The 2002 Master Plan recognized that a<br />
further amendment to the Development Plan would be required to implement<br />
Phase 6.<br />
Finally, although not part of the Article 80 process, the BRA will be asked to approve<br />
a text amendment to Article 41 of the <strong>Boston</strong> Zoning Code in connection with the<br />
<strong>Project</strong>, to approve height within the Planned Development Area (PDA) as proposed<br />
for the <strong>Project</strong> and to allow the size of floorplate above 155-feet to be determined<br />
through the Design Review process.<br />
