) The Contractor shall be solely liable to obtain and to abide by all necessary
licenses/permissions from the concerned authorities as provided under the various
Labour Law legislations including labour license from the competent authority under
the Contract Labour (Regulation & Abolition Act 1970).
c) The Contractor shall also be bound to discharge obligations as provided under
various statutory enactments including the Employees Provident Fund &
Miscellaneous Act, 1952, ESI Act, 1970). Minimum Wages Act 1936, Workmen's
Compensation Act, 1923 and other relevant Acts, Rules and Regulations enforced
from time to time.
d) The Contractor shall regularly submit all relevant records/documents in this regard
(salary sheet/PF & ESIC Challans, etc) to GAIL representative for verification and
upon such satisfaction only, GAIL will allow reimbursement of the monthly running
bills.
e) The Contractor shall ensure and shall be solely responsible for payment of wages and
other dues latest by 7th of the following month to the personnel deployed by him.
The Contractor shall be directly responsible and indemnify the company against all
charges, claims, dues, etc. arising out of disputes relating to the dues and
employment of personnel deployed by him.
f) The Contractor shall indemnify the Company against all losses or damages caused to
it on account of acts of the personnel deployed by the Contractor.
The Contractor shall ensure regular and effective supervision of the personnel
deployed by him.
1.11 The materials required to replace should be of same make, design and quality as
used/installed originally or else permission should be taken from Engineer-in-Charge
to use different make.
1.12 In case of any replacement of the material or fresh procurement or repairing
through outside agencies (items which are not mentioned in the BOQ) is required,
the Contractor shall supply /get done the same after informing the Engineer-incharge.
The cost of item & service charges will be paid to the Contractor as per
production of purchase voucher plus 10% extra. Further, in any maintenance
job/manpower for which there is no categorical mention in the tender, the same
work shall be got executed at the market rate and the contractor shall be paid 10%
extra on the actual expenditure incurred by the Contractor towards his profits and
overheads. The bill for carrying out such jobs should be duly certified by Engineerin-charge.
1.13 The 10% extra payable to the Contractor on account of materials and other
expenditure payable as per tender conditions includes profit, overheads, conveyance,
transportation, watch and ward, etc.
