59 General conditions <strong>for</strong><br />
construction and erection<br />
work:<br />
60 Alterations in specifications,<br />
design and extra works:<br />
consequence if any, including the cost thereto shall be exclusively<br />
borne by the CONTRACTOR and the EMPLOYER shall have no<br />
liability whatsoever on this account.<br />
59.1 The working time at the site <strong>of</strong> work is 48 hours per week.<br />
Overtime work is permitted in cases <strong>of</strong> need and the EMPLOYER<br />
will not compensate the same. Shift working at 2 or 3 shifts per<br />
day will become necessary and the CONTRACTOR should take<br />
this aspect into consideration <strong>for</strong> <strong>for</strong>mulating his rates <strong>for</strong><br />
quotation. No extra claims will be entertained by the EMPLOYER<br />
no this account. For carrying out work beyond working hours the<br />
CONTRACTOR will approach the ENGINEER-IN-CHARGE or his<br />
authorised representative and obtain his prior written permission.<br />
59.2 The CONTRACTOR must arrange <strong>for</strong> the placement <strong>of</strong> workers<br />
in such a way that the delayed completion <strong>of</strong> the WORK or any<br />
part there<strong>of</strong> <strong>for</strong> any reason whatsoever will not affect their proper<br />
employment. The EMPLOYER will not entertain any claim <strong>for</strong> idle<br />
time payment whatsoever.<br />
59.3 The CONTRACTOR shall submit to the<br />
EMPLOYER/ENGINEER-IN- CHARGE reports at regular<br />
intervals regarding the state and progress <strong>of</strong> WORK. The details<br />
and pr<strong>of</strong>orma <strong>of</strong> the report will mutually be agreed after the award<br />
<strong>of</strong> CONTRACT. The CONTRACTOR shall provide display<br />
boards showing progress and labour strengths at worksite, as<br />
directed by the ENGINEER-IN-CHARGE.<br />
60.1 The WORK covered under this CONTRACT having to be<br />
executed by the CONTRACTOR on a lumpsum firm price/item<br />
rate quoted by him, the EMPLOYER will not accept any proposals<br />
<strong>for</strong> changes in VALUE OF CONTRACT or extension in time on<br />
account <strong>of</strong> any such changes which may arise to the<br />
CONTRACTOR's scope <strong>of</strong> WORK as a result <strong>of</strong> detailed<br />
Engineering and thereafter during the execution <strong>of</strong> WORK. The<br />
only exception to this will be a case where the EMPLOYER<br />
requests in writing to the CONTRACTOR to upgrade the<br />
SPECIFICATIONS or the size <strong>of</strong> any major pieces <strong>of</strong> equipments,<br />
plant or machinery beyond what is normally required to meet the<br />
scope <strong>of</strong> WORK as defined in the CONTRACT DOCUMENT.<br />
In such cases, a change order will be initialled by the<br />
CONTRACTOR at the appropriate time <strong>for</strong> the EMPLOYER's<br />
prior approval giving the full back-up data <strong>for</strong> their review and <strong>for</strong><br />
final settlement <strong>of</strong> any impact on price within 30 (thirty) days<br />
thereafter.<br />
60.2 The ENGINEER-IN-CHARGE shall have to make any alterations<br />
in, omission from, additions to or substitutions <strong>for</strong>, the Schedule <strong>of</strong><br />
Rates, the original specifications, drawings, designs and<br />
instructions that may appear to him to be necessary or advisable<br />
during the progress <strong>of</strong> the WORK and the CONTRACTOR shall<br />
be bound to carry out the such altered/ extra/ new items <strong>of</strong> WORK<br />
in accordance with any instructions which may be given to him in<br />
writing signed by the ENGINEER-IN- CHARGE, and such<br />
alterations, omissions, additions or substitutions shall not<br />
invalidate the CONTRACT and any altered, additional or<br />
substituted work which the CONTRACTOR may be directed to do<br />
