1.14 All the materials to be used/replaced in maintenance should be of approved
quality and to the satisfaction of Engineer-in-charge. The replaced materials shall be
disposed off by the Contractor.
1.15 The Contractor shall not claim for sales tax, handling/ transportation charges
for the repairing and replacement. This is applicable for the equipments,
which is required to be taken out for repairing also.
1.0 FORCE MAJEURE: No liability shall be attached to the Contractor for nonoperation
or for execution of his obligation under this tender as a result of force
majeure i.e. earth quake, war, revolts, riots, floods, explosions and civil commotions
or any factor which in opinion of Engineer-in-Charge is beyond the control of the
Contractor.
2.0 The Contract is for a period of two years i.e. 24 months, from the date of award of
work. This may be extended further on mutual discussion and agreement. GAIL
reserves the right to terminate the Contract without assigning any reason during the
currency of the Tender period by giving 30 days notice to the Contractor.
3.0 The successful Bidder shall furnish to GAIL a performance bank guarantee (PBG) for
an amount of 10% of the total contract value. The PBG shall be valid till at least 3
months after the contractual completion period. The PBG shall be furnished within
fifteen (15 days) of the issue of the Letter of Selection, and the same shall be
returned back after three months from the date of completion of contract provided
all the bills are cleared and settled and no dispute is recorded. If the BG is not
submitted, the amount shall be adjusted against the first RA bill of the Contractor.
The rates quoted by the contractor shall be inclusive of all statutory taxes including
service tax and duties, statutory taxes and duties like TDS, WCT etc. shall be
recovered from the contractor’s bill as per rules. The rates quoted by the
contractor shall be firm and shall be applicable during the currency of the contract.
For Split/Window ACs/Water Coolers/Refrigerators etc :
1.19 The contractor should check all Windows/Split ACs, Water Coolers, Refrigerators,
etc before taking over the equipments from GAIL. If there are deficiencies found in
the equipments, they are to be rectified by the contractor at the earliest.
1.0 Any break down/repair works pertaining to the air conditioners should be taken-up
immediately by the contractor for effective performance of the air-conditioners.
2.0 Performance test on the grills of Window/Split ACs, Water Coolers and
Refrigerators shall be taken at least once in a week by the Contractor and the
recorded grill temperature of the ACs should not be more than 10-11 degree
Centigrade. The contractor shall record the grill temperature and all the equipments
