The valid regulatory framework of the country, based on the development of
awarding auctions for energy through generators that use renewable energies, has
turned out to be a good promotional mechanism, allowing for the first time the
implementation of wind and solar projects and the increase of hydroelectric
projects of small scale (minor to 20 MW), whose energy will be dispatch in the
SEIN.
In order to give a major boost to the development of projects with renewable
energies, attributions and interinstitutional competitions should be described in
detail. A problem generated by this cause, shows up in the case of water use
(requirement to obtain generation's authorization), where the Ministry of Energy
and Mines and the National Authority of Water overlap functions that in some
cases originate delays in the attention of files and authorizations for the projects’s
execution; as it has happened with the H.P.S. “La Joya” and the H.P.S. “Santa
Cruz”.
Some awardees, as the ones of the project W.F. “Talara”, show their worry and
advise checking aspects that improve the mechanisms established in the current
legislation, for instance with regard to the applicable correction factor to the
awarding tariff, when a RER generator does not fulfill its commitment of giving
the whole awarded energy.
In the case of the H.P.S. “Santa Cruz”, it has been observed that the mechanism
of anticipated recuperation of the general sales tax or IGV has to be redesigned in
order to make it applicable to renewable energy projects whose periods of
implementation are minor to 2 years.
For the case studies that have been presented in this document, the application to
the CDM improved the cash flow of the project. This has become a practice more
and more used by projects based on renewable energies. In some cases like the
one of the H.P.S. “La Joya”, part or the whole amount of bonds generated by the
sale of the CERs are conducted to benefit the community.
There is a temper of collaboration in regards to information about how to execute
similar projects, among the ones that have already made it and the ones that are in
the process of accomplishing them, as in the case of “Agroindustrial Paramonga”,
who has welcomed other interested sugar companies'representatives.
As it has been indicated previously, in the country is being working with success
the development of renewable energies. However, there still are some aspects to
be discussed and improved.
