1.4.2 General Tariff Regimen
The Law Nº 28832 that reinforces the ECL, rephrase the rules of the activities of
generation and transmission, the tariff regimen in each activity and the tariff to
the end user (which is constituted by the price at a generation level), the costs of
transmission and distribution (that include the retail commercialization):
Price at a Generation Level.- It is determined annually by the average of the
generation price regulated by the OSINERGMIN and the resulting firm
generation prices tha result from the electricity supplying tenders that could
convoke the State or the distributors, and where generators could present their
offers. These tenders are maken in the frame of the Law Nº 28832 and the Tendes
Regulation approved by S.D. Nº 052-2007 MS. Nowdays, close to 80 % of the
demand of the SEIN is supplied through these tenders. The tendency is that all the
demand would be conver with this sort of contracts. These contracts are for at
least 20 years and prices have firm character during the contractual period, taking
into account the updating formulas.
Transmission Cost.- They are constituted by the costs of the main and guaranteed
transmission system (MTS and GTS), and for the costs of the secondary and
complementary transmission systems (STS and CTS).
The costs of MTS and GTS are paid by the whole demand and the costs of STS
and CTS are paid only by their users.
The costs of the guaranteed transmission system are determined annually at the
same time that the costs at a generation level, recognizing the return of the whole
amount of investment. This amount is the result of tender processes of
concessions of the transmission lines that constitute the guaranteed transmission
system. These tenders constitute a tool for the implementation of the transmission
plan which is elaborated by the Committee for the Economic Operación of the
System (COES) and which is checked and approved by the Ministry of Energy
and Mines (MEM). The tenders are announce and guided by the Private
Investment Promotion Agency (PRO-INVESTMENT) for the request of the
MEM.
The costs of the Complementary Transmisión System are determined every four
years, recognizing the return of the efficient amount of investment. This amount
is the result of tender processes of concessions of the transmission lines.
Distribution cost.- Are determined every four years, recognizing the efficient
costs in the development of the distribution and commercialization activities of a
model company. Thus the distribution electrical systems of the whole country are
classified by Typical Distribución Sectors (TDS), chosing a model company for
each TDS. In the Graphic Nº 25 it is specified the end user price structure
according to the each one of the concepts that has been specified above.
