Electricity supply contracts that the State awards represent the guarantee of
income to make economically viable each RER generation project. The
development of a RER generation project generally follows the process described
below in concordance with the RER’s legal framework and the ECL:
• Measurement of the renewable energy resource (RE-R) and elaboration of the
project at a perfil or pre-feasibility level. For this stage, the promoter should
request temporary concession to the MEM for the realization of studies, only
if it requires of servitude over any land area for the studies’s development.
• Based on previous studies, the promoter could take part in one of the RER
auctions that the State convokes every two years. In that auctions the
promoter should fulfill requirements such having RER measurements at least
for 12-month, RER generation projects at pre-feasibility level, guarantees
established in the basis and the commitment to present the approval of the
COES of its pre-operativeness study.
• After the signature of the electricity supply contract for 20 years, it is returned
to the generator its guarantee of seriousness supply (20 000 US$ for each
installed MW), the same one that should be replaced by the guarantee of
works execution (100 000 US$ for each installed MW) that is returned to the
promoter at the start of commercial transaction of the main RER generation
station.
• Three months after signing the electricity supply contract, the promoter
should present its pre-operativeness study approved by the COES to the
MEM, out of guarantees in case of default.
• The promoter should elaborate its RER generation project at a feasibility level
(that includes its environmental impact assessment) and then its respective
final study for the construction of the project.
• Request the approval of the Environmental Impact Assessment (EIA) to the
MEM, which in conjunction with the feasibility study, constitute the main
requirements for the request to the MEM of the final concession.
• Requested and approved the final generation concession, the promoter signs
with the State (MEM) the contract of final concession, with which it could
initiate the construction of the project.
• Once the execution of the project is concluded, the promoter should request to
the OSINERGMIN the approval of setting in commercial transaction its
RER’s generation station.
• After getting all the evidence, the OSINERGMIN emits the approval to put
the project into commercial transaction and from that moment it starts the
contract term for the electricity supply to the SEIN for 20 years.
In the environmental aspect, the Law of the National System of Environmental
Impact Assessment (Law Nº 27446) and its Regulations establish a mandatory
application of the Environmental Certification for the development of projects in
general, defining the following categories: Category I - Environmental Impact
Statement (EIS); Category II - Semi-detailed Environmental Impact Assessment
(EIA sd) and Category III – Detailed Environmental Impact Assessment (EIAd).
