Prosecution and punishment <strong>of</strong> <strong>in</strong>ternational crimes by the Special Court for Sierra Leone 99<br />
Sierra Leone. 14 The SCSL has competence to render justice to the ‘victims<br />
and persons found guilty <strong>of</strong> serious violations <strong>of</strong> humanitarian law and<br />
Sierra Leonean law’. 15<br />
The SCSL commenced its operations on 1 July 2002. The first thirteen<br />
<strong>in</strong>dictments were approved by the court on 7 March 2003. 16 Of the thirteen<br />
<strong>in</strong>dictees, only twelve persons were arrested. John Paul Koroma still<br />
rema<strong>in</strong>s at large, but may have died <strong>in</strong> Liberia. Before the commencement<br />
<strong>of</strong> trials, Sam Bockarie and Foday Sankoh died. Samuel H<strong>in</strong>ga Norman<br />
died <strong>in</strong> detention whilst his trial was still proceed<strong>in</strong>g. The court was left<br />
with n<strong>in</strong>e persons who were prosecuted. These are Mo<strong>in</strong><strong>in</strong>a F<strong>of</strong>ana, Allieu<br />
Kondewa, Issa Hassan Sesay, Morris Kallon, August<strong>in</strong>e Gbao, Alex<br />
Tamba Brima, Brima Bazzy Kamara, Santigie Borbor Kanu and Charles<br />
Taylor. Of these n<strong>in</strong>e persons, eight have been convicted <strong>of</strong> war crimes and<br />
crimes aga<strong>in</strong>st humanity. The case aga<strong>in</strong>st Charles Taylor is still on trial<br />
before the Trial Chamber <strong>of</strong> the SCSL –sitt<strong>in</strong>g <strong>in</strong> The Hague, The<br />
Netherlands.<br />
On 27 January 2004, the Prosecutor <strong>of</strong> the SCSL jo<strong>in</strong>ed the cases <strong>of</strong><br />
n<strong>in</strong>e accused persons under the CDF Trial, 17 the RUF Trial 18 and the AFRC<br />
Trial. 19 Charles Taylor is tried separately. 20 The three jo<strong>in</strong>der cases<br />
<strong>in</strong>volv<strong>in</strong>g n<strong>in</strong>e accused persons have all been completed and the accuse<br />
have been sentenced to different terms <strong>of</strong> imprisonment. Mo<strong>in</strong><strong>in</strong>a F<strong>of</strong>ana<br />
was sentenced by the Appeals Chamber <strong>of</strong> the SCSL to a total <strong>of</strong> fifteen<br />
