In 2009, Sudan amended its Crim<strong>in</strong>al Act <strong>of</strong> 1991 through the efforts<br />

<strong>of</strong> the Arab League, <strong>in</strong>troduc<strong>in</strong>g <strong>in</strong>ternational crimes <strong>in</strong>to the Sudanese<br />

penal code. 103 Despite these developments there are still flaws <strong>in</strong> the<br />

Sudanese crim<strong>in</strong>al justice system. The Armed Forces Act <strong>of</strong> 2007, while<br />

crim<strong>in</strong>alis<strong>in</strong>g serious violations <strong>of</strong> <strong>in</strong>ternational humanitarian law and<br />

human rights law, also provides for immunity to members <strong>of</strong> the armed<br />

forces which can only be waived by the President. The Sudanese Crim<strong>in</strong>al<br />

Procedure Act (CPA) prohibits <strong>in</strong>vestigations and proceed<strong>in</strong>gs outside<br />

Sudan for any citizen that may have committed the crimes <strong>in</strong> the amended<br />

2009 Crim<strong>in</strong>al Act <strong>of</strong> 1991. The CPA also prohibits anyone <strong>in</strong> Sudan from<br />

assist<strong>in</strong>g <strong>in</strong> the extradition <strong>of</strong> any Sudanese for the prosecution <strong>of</strong> war<br />

crimes, crimes aga<strong>in</strong>st humanity and genocide. 104<br />

In relation to the ICC <strong>in</strong>vestigations <strong>in</strong> Darfur, on 27 April 2007, the<br />

Pre-Trial Chamber I issued an arrest warrant for 51 counts <strong>of</strong> crimes<br />

aga<strong>in</strong>st humanity and war crimes aga<strong>in</strong>st Ahmad Mohammed Harun<br />

(Mohammed Harun) and Mohammed Ali Abd-Al-Rahman (Ali Kushayb)<br />

for the crimes committed by the Sudanese Armed Forces (SAF) and the<br />

Janjaweed militia. 105 Sudan refused to co-operate with the court and,<br />

<strong>in</strong>stead, promoted Mohammed Harun to be the M<strong>in</strong>ister <strong>of</strong> State for<br />

Humanitarian Affairs from M<strong>in</strong>ister <strong>of</strong> State for the Interior <strong>of</strong><br />

Government <strong>of</strong> Sudan. 106 On 14 July 2008, the OTP applied for an arrest<br />

warrant aga<strong>in</strong>st President Omar Hassan Al Bashir for 10 charges <strong>of</strong><br />

genocide, crimes aga<strong>in</strong>st humanity and war crimes. 107<br />

The OTP argues that Al Bashir used state apparatus to commit<br />

massive crimes <strong>in</strong> Darfur. On 4 March 2009, Pre-Trial Chamber I issued<br />

an arrest warrant for Al Bashir for five counts <strong>of</strong> crimes aga<strong>in</strong>st humanity,<br />

<strong>in</strong>clud<strong>in</strong>g the crimes <strong>of</strong> exterm<strong>in</strong>ation, rapes and kill<strong>in</strong>gs, and two counts<br />

<strong>of</strong> war crimes, <strong>in</strong>tentionally direct<strong>in</strong>g attacks aga<strong>in</strong>st a civilian population<br />

as such or aga<strong>in</strong>st <strong>in</strong>dividual civilians not tak<strong>in</strong>g part <strong>in</strong> hostilities and<br />

pillag<strong>in</strong>g. The Court did not reta<strong>in</strong> the genocide charges. The OTP<br />

appealed aga<strong>in</strong>st this decision on 6 July 2009 and the Appeals Chamber,<br />

on 3 February 2010, decided that the Pre-Trial Chamber I applied an<br />

erroneous standard <strong>of</strong> pro<strong>of</strong> and directed the Pre-Trial Chamber I to decide<br />

on the correct standard <strong>of</strong> pro<strong>of</strong> whether a warrant <strong>of</strong> arrest should be<br />

issued aga<strong>in</strong>st Al Bashir for genocide.<br />
