Immunity <strong>of</strong> state <strong>of</strong>ficials and prosecution <strong>of</strong> <strong>in</strong>ternational crimes 41<br />

<strong>in</strong>struments, the <strong>of</strong>ficial capacity <strong>of</strong> a person is neither a defence for<br />

prosecution nor a mitigat<strong>in</strong>g factor <strong>in</strong> their punishment. The contemporary<br />

law on non-recognition <strong>of</strong> the immunity <strong>of</strong> state <strong>of</strong>ficials for <strong>in</strong>ternational<br />

crimes is article 27 <strong>of</strong> the Rome Statute, 1998, which sets out the position<br />

<strong>in</strong> <strong>in</strong>ternational law for the prosecution <strong>of</strong> <strong>in</strong>dividuals for <strong>in</strong>ternational<br />

crimes before <strong>in</strong>ternational courts.<br />

Recognis<strong>in</strong>g the <strong>in</strong>creas<strong>in</strong>g problem <strong>of</strong> the immunity <strong>of</strong> state <strong>of</strong>ficials<br />

before national courts, the <strong>International</strong> Law Commission (ILC) has<br />

embarked on a study on the immunity <strong>of</strong> state <strong>of</strong>ficials from foreign<br />

crim<strong>in</strong>al jurisdiction. At its fifty-eighth session <strong>in</strong> 2006, the ILC considered<br />

the topic <strong>in</strong> its long-term programme <strong>of</strong> work. The General Assembly <strong>of</strong><br />

the United Nations (UN) noted the decision <strong>of</strong> the ILC dur<strong>in</strong>g its fiftyeighth<br />

session <strong>of</strong> 2006 <strong>in</strong> Resolution 62/66 <strong>of</strong> 6 December 2007. At its fiftyn<strong>in</strong>th<br />

session <strong>in</strong> 2007, the ILC decided to <strong>in</strong>clude the topic ‘Immunity <strong>of</strong><br />

State Officials from foreign crim<strong>in</strong>al jurisdiction’ <strong>in</strong> its programme <strong>of</strong> work<br />

and appo<strong>in</strong>ted Roman Kolodk<strong>in</strong> as Special Rapporteur on the question <strong>of</strong><br />

immunity. 48 The Special Rapporteur submitted his prelim<strong>in</strong>ary report on<br />

immunity at the sixtieth session <strong>of</strong> the ILC <strong>in</strong> 2008 whereby the ILC<br />

considered the prelim<strong>in</strong>ary report. At its sixty-third session, the General<br />

Assembly <strong>of</strong> the United Nations adopted a resolution on the report <strong>of</strong> the<br />

ILC on the work <strong>of</strong> its sixtieth session on 15 January 2009. 49 Dur<strong>in</strong>g the<br />

ILC’s sixty-first session, the topic <strong>of</strong> immunity <strong>of</strong> state <strong>of</strong>ficials from<br />

foreign crim<strong>in</strong>al jurisdiction was <strong>in</strong>cluded <strong>in</strong> the provisional agenda for the<br />

sixty-first session convened at Geneva on 4 May 2009. However, at this<br />

session, the ILC did not consider the topic <strong>of</strong> immunity. 50 It is expected<br />

that the ILC will discuss it <strong>in</strong> subsequent sessions. Perhaps the ILC would<br />

not detract from the position already stated <strong>in</strong> the Rome Statute so as to<br />
