Inquiry, 18 the work it carried out rema<strong>in</strong>s the most extensive <strong>in</strong>vestigation<br />
ever carried out on the alleged human rights violations committed dur<strong>in</strong>g<br />
the Habré era. 19<br />
2.1 Torture<br />
Torture was committed systematically and at the highest levels <strong>of</strong> the<br />
Chadian state from 1982 to 1990, the period dur<strong>in</strong>g which Hissène Habré<br />
was President. CAT def<strong>in</strong>es torture as: 20<br />
any act by which severe pa<strong>in</strong> or suffer<strong>in</strong>g, whether physical or mental, is<br />
<strong>in</strong>tentionally <strong>in</strong>flicted on a person for such purposes as obta<strong>in</strong><strong>in</strong>g from him or<br />
a third person <strong>in</strong>formation or a confession, punish<strong>in</strong>g him for an act he or a<br />
third person has committed or is suspected <strong>of</strong> hav<strong>in</strong>g committed, or<br />
<strong>in</strong>timidat<strong>in</strong>g or coerc<strong>in</strong>g him or a third person, or for any reason based on<br />
discrim<strong>in</strong>ation <strong>of</strong> any k<strong>in</strong>d, when such pa<strong>in</strong> or suffer<strong>in</strong>g is <strong>in</strong>flicted by or at<br />
the <strong>in</strong>stigation <strong>of</strong> or with the consent or acquiescence <strong>of</strong> a public <strong>of</strong>ficial or<br />
other person act<strong>in</strong>g <strong>in</strong> an <strong>of</strong>ficial capacity. It does not <strong>in</strong>clude pa<strong>in</strong> or suffer<strong>in</strong>g<br />
aris<strong>in</strong>g only from, <strong>in</strong>herent <strong>in</strong> or <strong>in</strong>cidental to lawful sanctions.<br />
Dur<strong>in</strong>g the presidency <strong>of</strong> Habré, thousands <strong>of</strong> people suspected <strong>of</strong> not<br />
support<strong>in</strong>g his regime were taken to secret detention centres controlled by<br />
the DDS 21 and were subjected to torture and cruel, <strong>in</strong>human and<br />
degrad<strong>in</strong>g treatment. The UN Special Rapporteur on Torture draws a clear<br />
dist<strong>in</strong>ction between torture and cruel, <strong>in</strong>human or degrad<strong>in</strong>g treatment, by<br />
assert<strong>in</strong>g that the decisive criteria for dist<strong>in</strong>guish<strong>in</strong>g the first from the<br />
second ‘may best be understood to be the purpose <strong>of</strong> the conduct and the<br />
powerlessness <strong>of</strong> the victim, rather than the <strong>in</strong>tensity <strong>of</strong> the pa<strong>in</strong> or<br />
suffer<strong>in</strong>g <strong>in</strong>flicted.’ 22 Torture was used by DDS agents to obta<strong>in</strong><br />
confessions, punish or simply <strong>in</strong>still fear <strong>in</strong> the victims.<br />
18 The National Commission <strong>of</strong> Inquiry did not receive any form <strong>of</strong> assistance from the<br />
<strong>in</strong>ternational community and had even to fight to obta<strong>in</strong> a m<strong>in</strong>imal budget. The<br />
Commission was obliged to use the former <strong>of</strong>fices <strong>of</strong> the DDS s<strong>in</strong>ce it had no<br />
headquarters and that discouraged some victims from com<strong>in</strong>g and giv<strong>in</strong>g evidence.<br />
Furthermore, former members <strong>of</strong> the DDS who had been appo<strong>in</strong>ted <strong>in</strong> high positions<br />
with<strong>in</strong> some governmental agencies such as the new Centre de Recherches et de<br />
Coord<strong>in</strong>ation de Renseignements (Centre for Research and Co-ord<strong>in</strong>ation <strong>of</strong> Intelligence),<br />
were accused <strong>of</strong> <strong>in</strong>timidat<strong>in</strong>g the victims and witnesses. See Amnesty <strong>in</strong>ternational (n 2<br />

19 The Commission <strong>of</strong> Inquiry was able to <strong>in</strong>terview over 1 700 people, <strong>in</strong>clud<strong>in</strong>g 662<br />
former deta<strong>in</strong>ees, 786 close relatives <strong>of</strong> victims who died <strong>in</strong> detention or were<br />
summarily executed, 236 prisoners <strong>of</strong> war, 30 former DDS agents and 12 <strong>of</strong> Habré’s<br />

21 There were several DDS detention centres throughout N’djamena dur<strong>in</strong>g the Habré<br />
rule. The most-cited is the headquarters <strong>of</strong> the Brigade special d’<strong>in</strong>tervention rapide (BSIR)<br />
and the pisc<strong>in</strong>e, a swimm<strong>in</strong>g pool converted <strong>in</strong>to a prison. Some prisoners that Hissène<br />
Habré wanted to have close at hand were deta<strong>in</strong>ed with<strong>in</strong> the presidential palace.<br />
