Duty to prosecute <strong>in</strong>ternational crimes under <strong>in</strong>ternational law 25<br />

The establishment and operations s<strong>in</strong>ce the beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> the 90s <strong>of</strong><br />

several <strong>in</strong>ternational and hybrid crim<strong>in</strong>al tribunals, such as the<br />

<strong>International</strong> Crim<strong>in</strong>al Tribunals for the former Yugoslavia 94 and<br />

Rwanda, 95 the Special Court for Sierra Leone, 96 hybrid tribunals <strong>in</strong><br />

Kosovo 97 and East Timor, 98 Lebanon, 99 Bosnia and Herzegov<strong>in</strong>a, 100 and<br />

the Extraord<strong>in</strong>ary Chambers <strong>of</strong> the Crim<strong>in</strong>al Court <strong>in</strong> Cambodia, 101 are<br />

cited as evidence <strong>of</strong> an <strong>in</strong>ternational resolve to ensure that those most<br />

responsible for core <strong>in</strong>ternational crimes do not escape punishment. 102<br />

The ICC Statute is <strong>of</strong>ten construed as impos<strong>in</strong>g (or at least assum<strong>in</strong>g) an<br />

obligation on the part <strong>of</strong> the states that negotiated it to <strong>in</strong>vestigate and<br />

prosecute core <strong>in</strong>ternational crimes. 103<br />

Various <strong>in</strong>ternational documents refer to a duty to prosecute and<br />

punish serious crimes, <strong>in</strong>clud<strong>in</strong>g war crimes, crimes aga<strong>in</strong>st humanity and<br />

genocide. 104 While not conclusive, the frequent reiteration <strong>of</strong> a duty to<br />
