Implementation <strong>of</strong> the Rome Statute <strong>in</strong> South <strong>Africa</strong> 309<br />

<strong>Africa</strong>'s progressive Constitution 14 which conta<strong>in</strong>s an extensive list <strong>of</strong><br />

rights to which arrested, deta<strong>in</strong>ed and accused persons are entitled. 15<br />

The ICC Act is forward-look<strong>in</strong>g <strong>in</strong> that it provides for the amendment<br />

<strong>of</strong> domestic laws, such as the Crim<strong>in</strong>al Procedure Act 51 <strong>of</strong> 1977 and the<br />

Military Discipl<strong>in</strong>e Supplementary Measures Act 16 <strong>of</strong> 1999. Such<br />

amendments will br<strong>in</strong>g them <strong>in</strong> conformity with the def<strong>in</strong>ition <strong>of</strong> crimes<br />

under the Rome Statute and deals with several other co-operation issues<br />

such as arrest and surrender <strong>of</strong> persons and prosecution <strong>of</strong> <strong>of</strong>fences aga<strong>in</strong>st<br />

the adm<strong>in</strong>istration <strong>of</strong> justice <strong>in</strong> terms <strong>of</strong> the Rome Statute. As such, the<br />

ICC Act provides for <strong>in</strong>terpretations and def<strong>in</strong>itions consistent with the<br />

South <strong>Africa</strong>n Constitution and the Rome Statute. 16<br />

3 Analysis <strong>of</strong> the implementation <strong>of</strong> the<br />

<strong>International</strong> Crim<strong>in</strong>al Court Act<br />

3.1 Complementarity<br />

The ‘complementarity’ obligation placed on South <strong>Africa</strong>n courts is<br />

emphatically stated <strong>in</strong> the ICC Act. Section 3 <strong>of</strong> the Act def<strong>in</strong>es as one <strong>of</strong><br />

its objects:<br />

The enabl<strong>in</strong>g, as far as possible and <strong>in</strong> accordance with the pr<strong>in</strong>ciple <strong>of</strong><br />

complementarity, the national prosecut<strong>in</strong>g authority <strong>of</strong> the Republic to<br />

adjudicate <strong>in</strong> cases brought aga<strong>in</strong>st any person accused <strong>of</strong> hav<strong>in</strong>g committed a<br />

crime <strong>in</strong> the Republic and beyond the borders <strong>of</strong> the Republic <strong>in</strong> certa<strong>in</strong><br />

circumstances.<br />

When com<strong>in</strong>g to a decision about the prosecution <strong>of</strong> a perpetrator <strong>of</strong> an<br />

<strong>in</strong>ternational crime listed <strong>in</strong> the Rome Statute, section 5(3) requires the<br />

National Director <strong>of</strong> Prosecutions to recognise South <strong>Africa</strong>’s obligation<br />

under the pr<strong>in</strong>ciple <strong>of</strong> complementarity to exercise jurisdiction over and<br />

prosecute persons accused <strong>of</strong> hav<strong>in</strong>g committed an ICC crime. Therefore,<br />

prosecutors and courts <strong>in</strong> South <strong>Africa</strong> are now <strong>in</strong> a position to <strong>in</strong>vestigate,<br />

prosecute, try and sentence those persons guilty <strong>of</strong> the he<strong>in</strong>ous conduct<br />

that gives rise to these crimes. 17<br />

Article 86 describes the general duty on states to co-operate fully with<br />

the ICC <strong>in</strong> the <strong>in</strong>vestigation and prosecution <strong>of</strong> crimes. Article 87(7) goes<br />
