To conclude, <strong>in</strong>dividual crim<strong>in</strong>al responsibility is crucial as far as<br />

reconciliation is concerned. This is because hold<strong>in</strong>g <strong>in</strong>dividuals crim<strong>in</strong>ally<br />

responsible avoids assign<strong>in</strong>g guilt collectively, therefore enhanc<strong>in</strong>g trust<br />

between the two populations <strong>in</strong>volved <strong>in</strong> the conflict.<br />

6.3 Immunity<br />

It is worth mention<strong>in</strong>g that the ICTR and gacaca courts try <strong>in</strong>dividuals<br />

irrespective <strong>of</strong> their constitutional mandate with regard to the prosecution<br />

<strong>of</strong> genocide. Indeed, immunity is considered an obstacle <strong>in</strong> the fight<br />

aga<strong>in</strong>st impunity.<br />

7 Sentenc<strong>in</strong>g<br />

Neither the ICTR nor gacaca courts confer the death sentence; the heaviest<br />

penalty is life imprisonment. When abolish<strong>in</strong>g the death penalty <strong>in</strong> 2007,<br />

Rwanda replaced it with life imprisonment with solitary conf<strong>in</strong>ement as its<br />

severest sentence. It is worth mention<strong>in</strong>g that the abolition <strong>of</strong> the death<br />

penalty was one the conditions set by the ICTR for the transfer <strong>of</strong> cases to<br />

Rwanda, <strong>in</strong>clud<strong>in</strong>g cases <strong>of</strong> genocide.<br />

The genocide <strong>in</strong> Rwanda is peculiar due to the active <strong>in</strong>volvement <strong>of</strong><br />

the population. In fact, Rwanda’s political and military leaders may be<br />

considered as hav<strong>in</strong>g conceived the genocide, while a large number <strong>of</strong> the<br />

19 (5)any person who committed the <strong>of</strong>fence <strong>of</strong> rape or sexual torture, together<br />

with his or her accomplice.<br />

(6)The Prosecutor General <strong>of</strong> the Republic shall publish at least twice a year, a<br />

list <strong>of</strong> <strong>of</strong>fenders <strong>in</strong> the first category forwarded by the Gacaca Cell Courts.<br />

Second category:<br />

(1) a notorious murderer who dist<strong>in</strong>guished himself or herself <strong>in</strong> his or her<br />

location or wherever he or she passed due to the zeal and cruelty employed,<br />

together with his or her accomplice ;<br />

(2) any person who tortured another even though such torture did not result<br />

<strong>in</strong>to death, together with his or her accomplice;<br />

(3) any person who committed a dehumanis<strong>in</strong>g act on a dead body, together<br />

with his or her accomplice;<br />

(4) any person who committed or is an accomplice <strong>in</strong> the commission <strong>of</strong> an<br />

<strong>of</strong>fence that puts him or her on the list <strong>of</strong> people who killed or attacked others<br />

result<strong>in</strong>g <strong>in</strong>to death, together with his or her accomplice;<br />

(5) any person who <strong>in</strong>jured or attacked another with the <strong>in</strong>tention to kill but<br />

such <strong>in</strong>tention was not fulfilled, together with his or her accomplice;<br />

(6) any person who committed or aided another to commit an <strong>of</strong>fence aga<strong>in</strong>st<br />

another without <strong>in</strong>tention to kill, together with his or her accomplice.<br />

Third category:<br />

A person who only committed an <strong>of</strong>fence related to property. However, when<br />

the <strong>of</strong>fender and the victim come to a settlement by themselves, settle the<br />

matter before the authorities or before the witnesses before commencement <strong>of</strong><br />

this law, the <strong>of</strong>fender shall not be prosecuted.
