The trial <strong>of</strong> Mengistu and other Derg members <strong>in</strong> Ethiopia 183<br />

cont<strong>in</strong>ued association <strong>of</strong> these religious establishments with the rul<strong>in</strong>g<br />

regime. In the current Ethiopia, this association pervades all aspects <strong>of</strong><br />

civic life where it is rare to f<strong>in</strong>d an <strong>in</strong>dependent <strong>in</strong>stitution which dares to<br />

question the <strong>of</strong>ficial l<strong>in</strong>e and proposes an alternative approach.<br />

3.8 Institutional reform and effective governance<br />

The last <strong>of</strong> these important Chicago Pr<strong>in</strong>ciples <strong>of</strong> Post-Conflict Justice<br />

urges states to engage <strong>in</strong> <strong>in</strong>stitutional reform to support the rule <strong>of</strong> law,<br />

restore public trust, promote fundamental rights and support good<br />

governance. Aga<strong>in</strong>, the importance <strong>of</strong> these is not hard to see. 68 The ga<strong>in</strong>s<br />

from well-planned and executed accountability mechanisms could easily<br />

be reversed if these efforts are not followed through by <strong>in</strong>stitutional reform<br />

and effective governance that can restore the public’s trust <strong>in</strong> government.<br />

How has the Ethiopian government fared on these issues?<br />

It would be irresponsible not to admit that there have been some<br />

fundamental structural changes towards a better future. Regardless <strong>of</strong> the<br />

political disagreement about the government structure, the 1994<br />

Constitution <strong>of</strong> the Federal Democratic Republic <strong>of</strong> Ethiopia entrenched<br />

fundamental rights and freedoms, established key <strong>in</strong>stitutions and<br />

guaranteed their <strong>in</strong>dependence, at least on paper. However, the human<br />

rights practice <strong>of</strong> the <strong>in</strong>cumbent regime has been subjected to severe<br />

criticism to the extent <strong>of</strong> prompt<strong>in</strong>g some to openly claim that the Derg had<br />

been better s<strong>in</strong>ce it did not recognise human rights to beg<strong>in</strong> with, let alone<br />

mow<strong>in</strong>g down people who believed it was their right do so under the<br />

Constitution as has happened <strong>in</strong> post-Derg era. In other words, the rights<br />

<strong>in</strong> the Constitution are there only to enhance the democratic credentials <strong>of</strong><br />

the <strong>in</strong>cumbents <strong>in</strong> the eyes <strong>of</strong> western donors without whose support the<br />

regime could not survive and could not have become what it is today. This<br />

is a serious <strong>in</strong>dictment <strong>of</strong> the regime’s performance.<br />

4 Conclud<strong>in</strong>g remarks<br />

The human rights abuses committed by the Derg <strong>in</strong> Ethiopia from 1974 to<br />

1980, <strong>in</strong>clud<strong>in</strong>g the Red Terror era, represent only a portion <strong>of</strong> the human<br />

rights violations that occurred dur<strong>in</strong>g the Derg’s seventeen-year-rule.<br />

Ironically, the prosecution <strong>of</strong> the suspects took nearly eighteen years,<br />

longer than the Derg’s stay <strong>in</strong> power. The big fish, Colonel Mengistu Haile-<br />

Mariam, is still at large, sheltered by Zimbabwe. Given his key role <strong>in</strong> what<br />

had happened dur<strong>in</strong>g his rule, one cannot underestimate the impact his<br />

capture and surrender will have on the Ethiopian justice system as well as<br />

on the victims.<br />
