b<strong>in</strong>d<strong>in</strong>g the victim’s legs and hands and stuff<strong>in</strong>g objects <strong>in</strong>to their mouths;<br />

whipp<strong>in</strong>g while the victim is suspended; keep<strong>in</strong>g a bound victim<br />

suspended for long time; torture by electric shock; apply<strong>in</strong>g a burn<strong>in</strong>g<br />

newspaper to the body; pull<strong>in</strong>g out hair; mutilat<strong>in</strong>g the body; rubb<strong>in</strong>g a dry<br />

body or bones with a wooden board; stretch<strong>in</strong>g nails and nipples with<br />

p<strong>in</strong>cers; pull<strong>in</strong>g out f<strong>in</strong>gernails; kill<strong>in</strong>g or tortur<strong>in</strong>g others <strong>in</strong> the presence<br />

<strong>of</strong> the victim; frighten<strong>in</strong>g by sett<strong>in</strong>g dogs on a person; tak<strong>in</strong>g victim for a<br />

false execution; suspend<strong>in</strong>g heavy objects from men’s genitals; <strong>in</strong>sert<strong>in</strong>g<br />

heavy objects <strong>in</strong>to a woman’s uterus; forc<strong>in</strong>g a victim with wounded feet<br />

to walk on gravel; as well as other forms <strong>of</strong> torture not <strong>in</strong>cluded here.<br />

The accused persons were grouped <strong>in</strong>to three categories. The first<br />

category <strong>in</strong>cluded policy-makers, senior government, and military <strong>of</strong>ficials<br />

<strong>of</strong> the Derg. The two other groups were ‘military and civilian field<br />

commanders who carried out orders as well as passed orders down, and<br />

the <strong>in</strong>dividuals who actually carried out many <strong>of</strong> the brutal and deadly<br />

orders’. 17 The cases <strong>of</strong> the accused persons <strong>in</strong> the first category were heard<br />

by the Federal High Court First Crim<strong>in</strong>al Division. The trials <strong>of</strong> those <strong>in</strong><br />

the second category were conducted <strong>in</strong> Addis Ababa <strong>in</strong> the Federal High<br />

Court Sixth Crim<strong>in</strong>al Division and <strong>in</strong> the Regional Supreme Courts.<br />

In Special Prosecutor v Mengistu Haile-Mariam, aga<strong>in</strong>st top-tier accused<br />

persons, four charges were filed. 18 The first charge <strong>of</strong> public provocation<br />

and preparation to commit genocide <strong>in</strong> violation <strong>of</strong> articles 32(1)(a) and<br />

286(a) <strong>of</strong> the 1957 Penal Code reads: 19<br />

The defendants <strong>in</strong> violation <strong>of</strong> Articles 32 (1) (a) and 286(a) <strong>of</strong> the then 1957<br />

Penal Code <strong>of</strong> Ethiopia beg<strong>in</strong>n<strong>in</strong>g from 12 September 1974 by establish<strong>in</strong>g<br />

the Provisional Military Adm<strong>in</strong>istration Council, organis<strong>in</strong>g themselves as<br />

the general assembly, stand<strong>in</strong>g and sub-committees; while exclusively and<br />

collectively lead<strong>in</strong>g the country, agreed among themselves to commit and<br />

caused to be committed crimes <strong>of</strong> genocide aga<strong>in</strong>st those whom they<br />

identified as members <strong>of</strong> anti-revolution political groups. In order to assist<br />

them carry out these, they recruited and armed various kefitegna and kebele<br />

[adm<strong>in</strong>istrative units] leaders, revolutionary guards, cadres and revolutionary<br />

comrades whom as accomplices, they <strong>in</strong>cited and emboldened <strong>in</strong> public<br />

meet<strong>in</strong>g halls, over the media by call<strong>in</strong>g out the names <strong>of</strong> members <strong>of</strong> political<br />

groups call<strong>in</strong>g for their elim<strong>in</strong>ation us<strong>in</strong>g speeches, draw<strong>in</strong>gs and writ<strong>in</strong>gs<br />

until 1983 <strong>in</strong> various months and dates thereby caus<strong>in</strong>g the death <strong>of</strong><br />

thousands <strong>of</strong> members <strong>of</strong> political groups.<br />

The second charge <strong>of</strong> the commission <strong>of</strong> genocide <strong>in</strong> violation <strong>of</strong> article<br />
