October 2005 on the arrest <strong>of</strong> the leaders <strong>of</strong> the Lord’s Resistance Army<br />

(LRA) who were objects <strong>of</strong> ICC arrest warrants. In November 2005<br />

representatives <strong>of</strong> the ICC visited Khartoum to discuss matters relat<strong>in</strong>g to<br />

both the LRA and the situation <strong>in</strong> Darfur. 116<br />

The co-operation between the ICC and Sudan resulted <strong>in</strong> mutual<br />

exchanges <strong>in</strong> relation to judicial records and other documents relat<strong>in</strong>g to<br />

article 53 <strong>of</strong> the Rome Statute. Reports <strong>of</strong> the Sudanese National<br />

Commission <strong>of</strong> Inquiry and M<strong>in</strong>istry <strong>of</strong> Defence were also discussed.<br />

Sudanese <strong>of</strong>ficials were <strong>in</strong>terviewed <strong>in</strong> Khartoum under article 55 <strong>of</strong> the<br />

Rome Statute as potential witnesses, and five missions were undertaken to<br />

Khartoum, the last sometime between January and February 2007. 117<br />

However, the government severed an <strong>of</strong>ficial communication and cooperation<br />

with the OTP <strong>in</strong> April 2007 and embarked on a spirited<br />

campaign to discredit the ICC with the back<strong>in</strong>g <strong>of</strong> the Arab League 118 and<br />

the <strong>Africa</strong>n Union (AU). 119 In July 2008, some <strong>Africa</strong>n and Arab<br />

members <strong>of</strong> the UNSC supported by Ch<strong>in</strong>a and Russia proposed a deferral<br />

<strong>of</strong> ICC <strong>in</strong>vestigations under article 16 <strong>of</strong> the Rome Statute. This was done<br />

<strong>in</strong> a draft resolution to renew the mandate <strong>of</strong> the AU-UN Hybrid<br />

Operation <strong>in</strong> Darfur (UNAMID) on the grounds that the ICC arrest<br />

warrant was a threat to peace <strong>in</strong> Sudan. 120 The proposal was dropped from<br />

the resolution adopted to extend UNAMID because <strong>of</strong> a lack <strong>of</strong> support<br />

and consensus amongst members <strong>of</strong> the Security Council. 121<br />

It appears that the problem <strong>of</strong> prosecut<strong>in</strong>g those responsible for crimes<br />

<strong>in</strong> Sudan is a lack <strong>of</strong> political will and not necessarily the <strong>in</strong>ability <strong>of</strong> the<br />

Sudanese government to hold its nationals accountable. Accord<strong>in</strong>g to the<br />

OTP, 122<br />

The ability <strong>of</strong> the Sudanese judicial system to carry out proceed<strong>in</strong>gs has been<br />

demonstrated <strong>in</strong>ter alia by the decision, announced on 6 May by […] Justice<br />

M<strong>in</strong>ister Abdel-Basit Sabdarat, to prosecute those responsible for <strong>in</strong>vestment<br />

fraud up to $175 million <strong>in</strong> North Darfur. M<strong>in</strong>ister Sabdarat announced that<br />

58 suspects had been taken <strong>in</strong>to custody and would face crim<strong>in</strong>al charges,<br />

<strong>in</strong>clud<strong>in</strong>g two ex-police <strong>of</strong>ficers. The case shows that [Sudanese] authorities<br />

can prosecute serious crimes where there is will<strong>in</strong>gness to do so. The<br />
