South <strong>Africa</strong> has always been a fervent supporter <strong>of</strong> a permanent<br />

<strong>in</strong>ternational crim<strong>in</strong>al court. From the commencement <strong>of</strong> the negotiations<br />

towards the Rome Statute establish<strong>in</strong>g the <strong>International</strong> Crim<strong>in</strong>al Court,<br />

South <strong>Africa</strong> assumed a leadership role and was <strong>in</strong>fluential <strong>in</strong> draft<strong>in</strong>g the<br />

Rome Statute. 1 S<strong>in</strong>ce 1993 South <strong>Africa</strong> had participated <strong>in</strong> efforts to<br />

establish the ICC when the <strong>International</strong> Law Commission (ILC) had<br />

presented a draft statute to the General Assembly’s Sixth Committee for<br />

consideration. Subsequently, South <strong>Africa</strong> was frequently <strong>in</strong>vited to<br />

participate <strong>in</strong> the meet<strong>in</strong>gs <strong>of</strong> the bureau <strong>of</strong> the conference and was thus a<br />

member <strong>of</strong> the Draft<strong>in</strong>g Committee <strong>of</strong> the Rome Conference and coord<strong>in</strong>ated<br />

the formulation <strong>of</strong> significant parts <strong>of</strong> the Rome Statute,<br />

<strong>in</strong>clud<strong>in</strong>g part 4. 2<br />

South <strong>Africa</strong>’s prom<strong>in</strong>ent position with<strong>in</strong> the Southern <strong>Africa</strong>n<br />

Development Community (SADC) was also apparent dur<strong>in</strong>g the<br />

negotiation, ratification and implementation <strong>of</strong> the Rome Statute. SADC’s<br />

consultative meet<strong>in</strong>gs were held between 1995 and 1997 to explore the<br />

benefits and implications <strong>of</strong> establish<strong>in</strong>g an ICC. Thereafter, a conference<br />

<strong>of</strong> SADC member states was held from the 5 to 9 July 1999 <strong>in</strong> Pretoria,<br />

South <strong>Africa</strong>. Dur<strong>in</strong>g this conference, a Model Enabl<strong>in</strong>g Act, Ratification<br />
