developed by <strong>in</strong>ternational courts. The applicant for a subpoena requir<strong>in</strong>g<br />
a person to give testimony or submit to an <strong>in</strong>terview must show that three<br />
conditions are satisfied: ‘(i) reasonable attempts have been made to obta<strong>in</strong><br />
the voluntary cooperation <strong>of</strong> witnesses; (ii) the prospective witness has<br />
<strong>in</strong>formation which can materially assist the applicant <strong>in</strong> respect <strong>of</strong> clearly<br />
identified issues relevant to the trial; and (iii) the witness’s testimony must<br />
be necessary and appropriate for the conduct and fairness <strong>of</strong> the trial’. 79<br />
Subpoenas are not issued lightly. 80 Also, <strong>in</strong>formation sought from<br />
prospective witnesses must not be obta<strong>in</strong>able by other means except by<br />
subpoena. 81<br />
The ICTY and ICTR have taken <strong>in</strong>consistent positions on subpoenas<br />
aga<strong>in</strong>st serv<strong>in</strong>g state <strong>of</strong>ficials. In 2005, when Slobodan Milošević requested<br />
the ICTY to issue subpoenas for a pre-testimony <strong>in</strong>terview aga<strong>in</strong>st the then<br />
serv<strong>in</strong>g Prime M<strong>in</strong>ister <strong>of</strong> the United K<strong>in</strong>gdom (Tony Blair) and former<br />
Chancellor <strong>of</strong> Germany (Gerhard Schroder), 82 the tribunal did not issue<br />
the subpoenas. The Governments <strong>of</strong> the United K<strong>in</strong>gdom and Germany<br />
had argued that such leaders enjoyed immunity from testify<strong>in</strong>g before the<br />
ICTY. 83 The Trial Chamber <strong>of</strong> ICTY rejected the application and did not<br />
address the question <strong>of</strong> immunity because it had found that conditions had<br />
