accord<strong>in</strong>gly provides that such regulations would be <strong>in</strong>cluded as part <strong>of</strong> the<br />
Act. 63 To date, the M<strong>in</strong>ister has only made regulations provid<strong>in</strong>g for such<br />
aspects as the obta<strong>in</strong><strong>in</strong>g <strong>of</strong> evidence; restra<strong>in</strong>t orders; sentences;<br />
compensatory orders; and confiscation orders. 64<br />
9 Recent developments illustrat<strong>in</strong>g the effect <strong>of</strong><br />
implementation <strong>of</strong> the Rome Statute <strong>in</strong> South<br />
<strong>Africa</strong><br />
The adoption <strong>of</strong> a progressive implement<strong>in</strong>g Act on the ICC has ensured<br />
that South <strong>Africa</strong> plays a lead<strong>in</strong>g role on the cont<strong>in</strong>ent and is at the cutt<strong>in</strong>g<br />
edge <strong>of</strong> developments concern<strong>in</strong>g the <strong>in</strong>terpretation, implementation and<br />
enforcement <strong>of</strong> the Rome Statute. 65 This momentum and South <strong>Africa</strong>’s<br />
good repute have unfortunately suffered a decl<strong>in</strong>e <strong>in</strong> recent months due to<br />
South <strong>Africa</strong>’s apparent ‘amnesia’ concern<strong>in</strong>g the obligations it had<br />
voluntarily undertaken.<br />
Du Plessis prophetically stated <strong>in</strong> 2004 that the true test for the ICC<br />
Act will come when an <strong>in</strong>ternational crim<strong>in</strong>al makes his or her appearance<br />
on our territory. 66 Notwithstand<strong>in</strong>g the perception that South <strong>Africa</strong> is<br />
committed to the fight aga<strong>in</strong>st impunity, South <strong>Africa</strong> has recently found<br />
itself mired <strong>in</strong> controversy concern<strong>in</strong>g its external position on the ICC<br />
s<strong>in</strong>ce it has been criticised for sacrific<strong>in</strong>g the ideals <strong>of</strong> <strong>in</strong>ternational justice<br />
on the altar <strong>of</strong> political expediency. 67 In particular, South <strong>Africa</strong>’s recent<br />
position on the ICC has not been a model <strong>of</strong> clarity. 68 Events turn<strong>in</strong>g on<br />
fundamental pr<strong>in</strong>ciples <strong>of</strong> <strong>in</strong>ternational crim<strong>in</strong>al law whereupon South<br />
<strong>Africa</strong> was expected to take decisive action can be classified under the<br />
follow<strong>in</strong>g broad discussion issues: South <strong>Africa</strong>’s response to the article 98<br />
Bilateral Immunity Agreements imposed by the United States <strong>of</strong> America;<br />
attempts to arrest ZANU-PF <strong>of</strong>ficials who had been accused <strong>of</strong><br />
committ<strong>in</strong>g crimes aga<strong>in</strong>st humanity <strong>in</strong> Zimbabwe and who were<br />
subsequently on South <strong>Africa</strong>n territory; South <strong>Africa</strong>’s [ambiguous]<br />
position with regards to the <strong>in</strong>ternational arrest warrant issued by the ICC<br />
for Sudanese President Omar Al Bashir; the ‘Gaza docket’; and South<br />
<strong>Africa</strong>’s controversial proposal concern<strong>in</strong>g an amendment to article 16 <strong>of</strong><br />
