Western National Insurance GroupInstructions To AgentsNotification of Change to Western National - Agency Agreement – All States –(5 business days).As it states in the agency agreement entitled “Instructions to Agents”, all “applications, policyorders, daily reports and binders shall be forwarded no later than five (5) working daysfollowing acceptance of each risk.”Altering Existing Policies – Written Binders Required – (3 business days)Minnesota Insurance Code 60K. 46. Subd. 7.An insurance producer having express authority to bind coverage, who orally agrees on behalf ofan insurer to provide insurance coverage, or to alter an existing insurance agreement, shallexecute and deliver a written memorandum or binder containing the terms of the oralagreement to the insured within three (3) business days from the time the oral agreement isentered.Discrepancy Between Premium Quoted and Policy Issuance - MinnesotaPolicies are to be written at rates, and in accordance with rules and underwriting informationauthorized and published by Western National. Should a discrepancy occur between the quotedpremium and the premium generated with the policy issuance, it is the position of the CommerceDepartment that any errors in quotes or policy presentations by the agent are the company’sresponsibility and that the company must honor those terms for the initial policy period. It is theposition of Western National that the agency is given the tools to accurately produce quotes andthe agency will ultimately be held responsible for the discrepancy.Mutual Underwriting Information – October 2012 Page 7
