WESTERN NATIONAL MUTUAL INSURANCEPersonal Automobile ManualRule 1.DefinitionsA. Private Passenger Auto1. A private passenger auto is a four wheelmotor vehicle, other than a truck type, ownedor leased under contract for a continuousperiod of at least six months; anda. Not used as a public or livery conveyancefor passengers;b. Not rented to others.2. A motor vehicle that is a pickup or van shallbe considered a private passenger auto if it;a. Has a Gross Vehicle Weight Rating of10,000 lbs. or less, or is a vehicle with aGross Vehicle Weight Rating greaterthan 10,000 lbs. for which a symbol isdisplayed in the Symbol and IdentificationManual; andb. Is not used for the delivery or transportationof goods or materials unless suchuse is:(1) Incidental to the insured’s businessof installing, maintaining or repairingfurnishings or equipment, or(2) For farming or ranching.A pickup or van used in the business of theUnited States Government, by an employeeof the Government, shall be considered aprivate passenger auto only if;a. It meets the conditions in a. and b.above; andb. Coverage is limited in accordance withthe Federal Employees Using Autos inGovernment Business endorsementPP 03 01.3. A motor vehicle owned by a farm family copartnership,or farm family corporation shallbe considered a private passenger autoowned by two or more relatives who areresidents of the same household if:a. It is principally garaged on a farm orranch; andb. It otherwise meets the definitions in 1.and 2. above.REFER TO COMPANYB. Auto as used in this manual refers to a privatepassenger auto or a vehicle considered as aprivate passenger auto.C. Liability as used in this manual refers only toBodily Injury and Property Damage Coverages.D. Comprehensive Coverage as used in this manualrefers to other than collision damage (OTC)to a motor vehicle.E. Owned as used in this manual includes:1. An auto leased under contract for acontinuous period of at least six months. Ifan auto lease contract requires the lessee toprovide primary insurance for the lessor,attach the Additional Insured-Lessorendorsement PP 03 19.2. A vehicle owned by a trust. Refer to Rule2.E. for eligibility requirements applicable tovehicles owned by a trust.The named insured must have legal title toand ownership of the vehicle(s) insured.Vehicles owned by children or other membersof the household must be placed on policiesin their name (subject to eligibility).F. Family Member means a person related to youby blood, marriage or adoption who is a residentof your household.G. Gross Vehicle Weight Rating as used in thismanual refers to the maximum loaded weight forwhich a single vehicle is designed, as specifiedby the manufacturer.H. Farm Truck means all single unit trucks used bythe owner to transport agriculture and farmproducts from the farm to market, and to transportproperty and supplies to the farm. Thedefinition will not include truck tractors, tractors,or semitrailers and does not include any haulingfor hire.REFER TO COMMERCIAL AUTO PROGRAMI. Classic Auto is a motor vehicle of the privatepassenger type which is 10 or more years oldand may be used on a regular basis. Its value issignificantly higher than the average value ofother autos of the same make and model year.REFER TO SPECIALTY MARKETSK. Antique Auto is a motor vehicle of the privatepassenger type which is 25 or more years oldand is maintained primarily for use in exhibitions,club activities, parades, other activities, otherfunctions of public interest, and occasionally usedfor other purposes.REFER TO SPECIALTY MARKETSL. Collector Auto is a motor vehicle that is ownedand operated solely as a collector’s item and notfor general transportation purposes.REFER TO SPECIALTY MARKETSM. Kits/Replicas/Custom And Modified Autos arespecial vehicles that may have been made by theowners of the custom-built cars or made byothers on their behalf. These cars are mademostly of fiberglass material and therefore moresubject to damage. Examples include dunebuggies, hot rods, kit cars, etc.REFER TO SPECIALTY MARKETSRule 2.Personal Auto Policy - EligibilityA. A Personal Auto Policy shall be used to affordcoverage to private passenger autos and motorvehicles considered as private passenger autosin Rule 1., if:1. They are written on a specified auto basis,and2. They are owned by an individual or by:a. A husband and wife who are residents inthe same household; orb. Domestic partnerships or non-traditionalcouples within the same household if;• At least one vehicle on the policy isco-titled or;• Western National writes the HO andit is co-titled and;• Both named insureds sign the Non-Traditional Partnership Supplementand an application;• Both share the same primaryresidence and;• Both are in a committed relationshipof mutual caring and;• Both are not married (to each other oranybody else) and;• Both are each other’s sole domesticpartners and;• Both are jointly responsible for basicliving expenses and;• Both are expecting their domesticpartnership to be long term.Both husband and wife who are residentsin the same household, or both parties tothe domestic partnership, may be listedas named insureds on the declarationspage.B. A Personal Auto Policy shall be used to affordcoverage to private passenger autos, and pickupsand vans as defined in Rule 1. that areowned jointly by two or more:1. Resident relatives other than:a. Husband and wife; orb. Parties who have entered into adomestic partnership as defined inRule 2.A.2.b;2. Resident individuals; or3. Non-resident relatives, including:a. A non-resident husband and wife; orb. Non-resident parties who have enteredinto a domestic partnership as defined inRule 2.A.2.bIf:- They are written on a specified auto basis,- The policy affords coverage only for such privatepassenger autos, pickups or vans whichare jointly owned, and- The Joint Ownership Coverage endorsementPP 03 34 is attached. Refer to theendorsement for the extent of coverage.NOTEThe insurer may elect to not apply the non-ownedauto liability coverage exclusion under the JointOwnership Coverage endorsement.
