<strong>Child</strong> <strong>and</strong> <strong>adult</strong> <strong>labour</strong> <strong>in</strong> <strong>the</strong> <strong>gem</strong> polish<strong>in</strong>g <strong>export</strong> <strong>in</strong>dustry <strong>of</strong> Jaipur<br />

<strong>in</strong>dustry <strong>in</strong> Jaipur than <strong>the</strong> figure <strong>of</strong> <strong>the</strong> Gurupadaswamy Committee.<br />

The children, like <strong>the</strong> <strong>adult</strong>s, work 8 to 10 hours per day <strong>and</strong> earn a small part <strong>of</strong> what <strong>adult</strong><br />

workers earn. These children are deprived <strong>of</strong> mean<strong>in</strong>gful education <strong>and</strong> play. Gem polish<strong>in</strong>g, <strong>and</strong><br />

even more jewellery mak<strong>in</strong>g, were traditional occupations <strong>in</strong> Jaipur. <strong>Child</strong>ren learnt <strong>the</strong> craft from<br />

<strong>the</strong>ir fa<strong>the</strong>rs. '<strong>Child</strong>ren were work<strong>in</strong>g with <strong>the</strong>ir parents but <strong>the</strong>y comb<strong>in</strong>ed school with learn<strong>in</strong>g<br />

<strong>the</strong> craft. It required a certa<strong>in</strong> amount <strong>of</strong> knowledge about <strong>the</strong> trade <strong>and</strong> <strong>the</strong> outside world, for<br />

which education was essential. S<strong>in</strong>ce <strong>the</strong> dem<strong>and</strong> for <strong>gem</strong> stones was not very high, child <strong>labour</strong><br />

was not very widely prevalent' 135 . But s<strong>in</strong>ce <strong>the</strong> <strong>in</strong>creased <strong>in</strong>ternational dem<strong>and</strong> for <strong>gem</strong> stones<br />

<strong>the</strong> growth <strong>of</strong> <strong>the</strong> <strong>in</strong>dustry seems to have also led to a rise <strong>in</strong> <strong>the</strong> employment <strong>of</strong> children under 14<br />

years <strong>of</strong> age, which are <strong>the</strong> cheapest <strong>labour</strong>ers.<br />

The wages <strong>of</strong> <strong>adult</strong> workers are above <strong>the</strong> legal M<strong>in</strong>imum Wage which makes <strong>the</strong> <strong>in</strong>dustry extra<br />

attractive for poor families which see <strong>the</strong> <strong>in</strong>dustry as a way for upward mobility, especially for<br />

<strong>the</strong>ir children. Employers or contractors f<strong>in</strong>d child <strong>labour</strong> quite cheap <strong>and</strong> <strong>the</strong>refore economically<br />

attractive, <strong>and</strong> parents let <strong>the</strong>ir children work because it pays relatively well <strong>and</strong> is one way <strong>of</strong><br />

supplement<strong>in</strong>g <strong>the</strong> family <strong>in</strong>come 136 . The lucrativeness <strong>of</strong> <strong>the</strong> bus<strong>in</strong>ess, with hopes on high<br />

earn<strong>in</strong>gs, has driven many more people <strong>in</strong>to <strong>the</strong> <strong>in</strong>dustry at all levels.<br />

It was always said that <strong>the</strong> <strong>labour</strong> force largely consists <strong>of</strong> workers from traditional artisan<br />

families which h<strong>and</strong> down <strong>the</strong> skills from one generation to <strong>the</strong> next. But <strong>the</strong> relatively recent<br />

boom<strong>in</strong>g <strong>of</strong> <strong>the</strong> <strong>export</strong>s <strong>of</strong> <strong>gem</strong> stones from Jaipur has led to <strong>the</strong> arrival <strong>of</strong> many people who are<br />

not from artisan families.<br />

A recent survey <strong>of</strong> <strong>the</strong> <strong>in</strong>dustry <strong>in</strong> Jaipur revealed that 'though 80% amongst those <strong>in</strong>volved<br />

<strong>in</strong> <strong>gem</strong> studded jewellery manufactur<strong>in</strong>g were part <strong>of</strong> a family bus<strong>in</strong>ess, only 20% had<br />

set up <strong>the</strong>ir own bus<strong>in</strong>ess'. The survey revealed fur<strong>the</strong>r that '<strong>in</strong> <strong>the</strong> case <strong>of</strong> process<strong>in</strong>g <strong>of</strong><br />

precious stones, <strong>the</strong> percentages reflected exactly <strong>the</strong> opposite picture: 20% said it was<br />

<strong>the</strong>ir family bus<strong>in</strong>ess <strong>and</strong> 80% had set up a bus<strong>in</strong>ess <strong>in</strong> <strong>gem</strong> polish<strong>in</strong>g. In <strong>the</strong> area <strong>of</strong><br />

semi-precious stones, <strong>the</strong> survey revealed that <strong>the</strong> break-up was even sharper with only<br />

5% belong<strong>in</strong>g to a family tradition, while 95% <strong>of</strong> <strong>the</strong> surveyed people had set up an<br />

enterprise <strong>in</strong>dependently' 137 .<br />

The <strong>gem</strong> polish<strong>in</strong>g <strong>in</strong>dustry <strong>of</strong> Jaipur has a dist<strong>in</strong>ct character. It is based on mutual trust.<br />

Everyth<strong>in</strong>g happens 'face-to-face' <strong>and</strong> no written records perta<strong>in</strong><strong>in</strong>g to <strong>the</strong> terms <strong>of</strong> trade, <strong>the</strong> total<br />

volume <strong>of</strong> goods transferred or sold, <strong>the</strong> placement <strong>of</strong> orders or <strong>the</strong>ir mode <strong>of</strong> payment <strong>and</strong><br />

execution, are ever ma<strong>in</strong>ta<strong>in</strong>ed with any government department/agency 138 . Most <strong>of</strong> <strong>the</strong> manufactur<strong>in</strong>g<br />

units are not registered <strong>and</strong> no records are kept <strong>of</strong> <strong>the</strong> employees who are work<strong>in</strong>g <strong>in</strong> <strong>the</strong><br />

units, which means <strong>the</strong>y are not permanent workers. The <strong>in</strong>dustry, due to its <strong>in</strong>formal nature, does<br />

not come under <strong>the</strong> purview <strong>of</strong> <strong>the</strong> majority <strong>of</strong> <strong>labour</strong> laws. For example, workers are not entitled<br />

to any benefits <strong>of</strong> <strong>the</strong> Factories Act because <strong>the</strong>se units do not fall with<strong>in</strong> <strong>the</strong> def<strong>in</strong>ition <strong>of</strong> what<br />
