6 Introduction<br />

──────────────────────────────────────────────────────────────────────────────────────────────<br />

people, which shows <strong>the</strong> magnitude <strong>of</strong> <strong>the</strong> child <strong>labour</strong> problem <strong>in</strong> <strong>India</strong>.<br />

The majority <strong>of</strong> <strong>the</strong> child <strong>labour</strong>ers <strong>in</strong> <strong>India</strong> works with <strong>the</strong>ir parents <strong>in</strong> <strong>the</strong> agricultural sector.<br />

Ma<strong>in</strong>ly girls work as full-time housemaids, <strong>of</strong>ten for <strong>the</strong> middle class. <strong>Child</strong>ren, boys <strong>and</strong> girls,<br />

work <strong>in</strong> factories <strong>and</strong> workshops where <strong>the</strong>y clean <strong>and</strong> pack food, weave carpets, sew <strong>and</strong> embroider<br />

<strong>garment</strong>s, glue shoes, carry molten glass, cure lea<strong>the</strong>r, make matches, locks <strong>and</strong> firework,<br />

<strong>and</strong> polish <strong>gem</strong> stones, to mention a few occupations. Besides, children work <strong>in</strong> restaurants <strong>and</strong> a<br />

large number is self-employed, hawk<strong>in</strong>g everyth<strong>in</strong>g from cigarettes to flowers. <strong>Child</strong>ren even sell<br />

<strong>the</strong>mselves as prostitutes. O<strong>the</strong>r work children are do<strong>in</strong>g is scaveng<strong>in</strong>g <strong>and</strong> sort<strong>in</strong>g garbage,<br />

crush<strong>in</strong>g bricks <strong>and</strong> stones <strong>and</strong> work<strong>in</strong>g <strong>in</strong> road constructions <strong>and</strong> m<strong>in</strong>es. These are not exclusive<br />

categories <strong>and</strong> may overlap.<br />

While <strong>the</strong>re are conflict<strong>in</strong>g data regard<strong>in</strong>g <strong>the</strong> number <strong>of</strong> children who are employed <strong>in</strong> <strong>the</strong> workplace,<br />

'it is observed that <strong>the</strong> economic exploitation <strong>of</strong> children <strong>in</strong> <strong>India</strong> is extensive <strong>and</strong> appears<br />

to have <strong>in</strong>creased over recent years' 10 . Ano<strong>the</strong>r observation is that child <strong>labour</strong> imposed a great<br />

cost on <strong>the</strong> economy <strong>of</strong> <strong>India</strong> <strong>in</strong> terms <strong>of</strong> '<strong>the</strong> opportunity lost to develop <strong>the</strong> country's human<br />

resources'.<br />

<strong>India</strong> is one <strong>of</strong> <strong>the</strong> countries which are <strong>in</strong> <strong>the</strong> race for gett<strong>in</strong>g a larger share <strong>of</strong> <strong>the</strong> world trade with<br />

<strong>the</strong> aim to partly solve <strong>the</strong>ir debt, unemployment <strong>and</strong> poverty problem. S<strong>in</strong>ce its economic reforms<br />

<strong>of</strong> 1991, <strong>India</strong> is actively <strong>in</strong>volved <strong>in</strong> open<strong>in</strong>g up its market to <strong>the</strong> world market. In a fast<br />

tempo <strong>India</strong> is chang<strong>in</strong>g from an economy where <strong>the</strong> rules were set by <strong>the</strong> Government <strong>in</strong>to a<br />

market economy. To reduce its above mentioned problems, <strong>India</strong> makes use <strong>of</strong> many economic<br />

growth mechanisms; besides <strong>in</strong>vit<strong>in</strong>g (foreign) <strong>in</strong>vestments, <strong>the</strong> Government <strong>of</strong> <strong>India</strong> is stimulat<strong>in</strong>g<br />

<strong>export</strong>-<strong>oriented</strong> <strong>in</strong>dustries. The most lucrative, <strong>labour</strong> <strong>in</strong>tensive <strong>and</strong> competitive <strong>export</strong><strong>oriented</strong><br />

<strong>in</strong>dustries, like <strong>the</strong> <strong>gem</strong> <strong>and</strong> jewellery <strong>and</strong> <strong>garment</strong> <strong>in</strong>dustry, are supported most by <strong>the</strong><br />

Government <strong>in</strong> terms <strong>of</strong> <strong>in</strong>vestments <strong>and</strong> tax exemptions, etc, s<strong>in</strong>ce <strong>the</strong>y br<strong>in</strong>g <strong>in</strong> much foreign<br />

exchange <strong>and</strong> generate employment. Accord<strong>in</strong>g to <strong>the</strong> Confederation <strong>of</strong> <strong>India</strong>n Industries, <strong>the</strong><br />

competitive edge <strong>in</strong> <strong>the</strong>se <strong>in</strong>dustries <strong>and</strong> o<strong>the</strong>r major foreign exchange earners like <strong>the</strong> carpet,<br />

brass artware, h<strong>and</strong>loom, tea <strong>in</strong>dustry etc., is partly provided by child <strong>labour</strong>ers 11 ; 'as <strong>the</strong>y are paid<br />

less than <strong>adult</strong>s <strong>and</strong> do not dem<strong>and</strong> social security benefits <strong>and</strong> are, <strong>the</strong>refore, able to produce<br />

goods at a lower cost' 12 . On <strong>the</strong> o<strong>the</strong>r h<strong>and</strong>, a recent ILO study 13 <strong>in</strong>dicates that some <strong>in</strong>dustries<br />

with a large number <strong>of</strong> child <strong>labour</strong>ers, like for example <strong>the</strong> glass-bangles <strong>and</strong> diamond polish<strong>in</strong>g<br />

<strong>in</strong>dustry, can very well survive without child <strong>labour</strong>. <strong>Child</strong> <strong>labour</strong>, however, <strong>in</strong>creases <strong>the</strong> pr<strong>of</strong>its.<br />

Though <strong>the</strong> above mentioned <strong>in</strong>dustries are supported by <strong>the</strong> government to <strong>in</strong>crease <strong>the</strong>ir <strong>export</strong>s,<br />

<strong>the</strong>y are at <strong>the</strong> same time neglected by <strong>the</strong> Government <strong>in</strong> terms <strong>of</strong> <strong>labour</strong> <strong>in</strong>spections <strong>and</strong><br />
