created a climate <strong>in</strong> which also <strong>the</strong> European importers, retailers <strong>and</strong> consumers can play a<br />

positive role by dem<strong>and</strong><strong>in</strong>g <strong>garment</strong>s produced without child <strong>labour</strong>, <strong>and</strong> under decent <strong>labour</strong><br />

conditions for <strong>adult</strong>s.<br />

8. When child <strong>labour</strong> is almost absent <strong>in</strong> an <strong>in</strong>dustry, women <strong>labour</strong> is <strong>the</strong> next section <strong>of</strong> <strong>the</strong><br />

<strong>labour</strong> force which is prone to exploitation. The <strong>export</strong>-<strong>oriented</strong> <strong>garment</strong> <strong>in</strong>dustry <strong>in</strong><br />

Bangalore is an example <strong>of</strong> this phenomenon. If children are go<strong>in</strong>g to be replaced by <strong>adult</strong>s,<br />

women are <strong>the</strong> next 'target group'. This asks for measures to improve <strong>the</strong>ir work<strong>in</strong>g conditions<br />

as well, like: <strong>the</strong> right to collective barga<strong>in</strong><strong>in</strong>g, a 'need based' m<strong>in</strong>imum wage, permanent<br />

employment, <strong>the</strong> availability <strong>of</strong> a creche at <strong>the</strong> workplace, social security <strong>and</strong> regular<br />

checks on a normal work<strong>in</strong>g day <strong>of</strong> 8 hours without work<strong>in</strong>g overtime, <strong>in</strong> nightshifts or on<br />

Sundays.<br />

9. European retailers, cha<strong>in</strong>-stores <strong>and</strong> buy<strong>in</strong>g houses are contribut<strong>in</strong>g to economic exploitation<br />

<strong>of</strong> children <strong>and</strong> women workers by buy<strong>in</strong>g <strong>garment</strong>s from manufacturers <strong>in</strong> Tirupur <strong>and</strong><br />

Bangalore if <strong>the</strong>y do not require from <strong>the</strong>ir supplier(s) to abide by m<strong>in</strong>imum <strong>labour</strong> norms<br />

like absence <strong>of</strong> child <strong>labour</strong>, 'need based' wages, a permanent employment contract, social<br />

security, <strong>the</strong> right to collective barga<strong>in</strong><strong>in</strong>g, a normal 8-hour work<strong>in</strong>g day etc. The marketdriven<br />

push to purchase <strong>garment</strong>s at <strong>the</strong> lowest possible price, without tak<strong>in</strong>g <strong>the</strong>se basic<br />

<strong>labour</strong> st<strong>and</strong>ards <strong>in</strong>to consideration, will lead to cont<strong>in</strong>ued exploitation <strong>of</strong> children <strong>and</strong> o<strong>the</strong>r<br />

workers.<br />

10. The government <strong>of</strong> Tamil Nadu does not acknowledge bonded (child) <strong>labour</strong> <strong>in</strong> its state <strong>and</strong><br />

is unwill<strong>in</strong>g to do someth<strong>in</strong>g about <strong>the</strong> problem <strong>of</strong> bonded (child) <strong>labour</strong> which is prevalent<br />

<strong>in</strong> <strong>the</strong> syn<strong>the</strong>tic <strong>gem</strong> polish<strong>in</strong>g <strong>in</strong>dustry <strong>in</strong> <strong>and</strong> around Trichy <strong>and</strong> o<strong>the</strong>r parts <strong>in</strong> Tamil Nadu.<br />

Due to <strong>the</strong> absence <strong>of</strong> an enforcement mach<strong>in</strong>ery <strong>in</strong> Tamil Nadu, especially <strong>in</strong> <strong>the</strong> rural areas,<br />

<strong>and</strong> <strong>of</strong> job alternatives for <strong>the</strong> poor <strong>and</strong> irregular agricultural activities due to heavy droughts,<br />

syn<strong>the</strong>tic <strong>gem</strong> stone manufacturers <strong>and</strong> entrepreneurs have a monopoly <strong>in</strong> generat<strong>in</strong>g<br />

employment <strong>and</strong> can cont<strong>in</strong>ue <strong>the</strong> system <strong>of</strong> debt bondage. Bonded child <strong>labour</strong>ers, who<br />

carry <strong>the</strong> debt <strong>of</strong> <strong>the</strong>ir parents with <strong>the</strong>m for <strong>the</strong> rest <strong>of</strong> <strong>the</strong>ir lives, are not free to move to<br />

o<strong>the</strong>r jobs <strong>and</strong>/or areas <strong>and</strong> can never go to school aga<strong>in</strong>. Employers pay very low wages<br />

because <strong>the</strong> workers have a debt with <strong>the</strong>m which can be ten to a thous<strong>and</strong> times <strong>the</strong>ir wage.<br />

The parents (<strong>and</strong> <strong>the</strong> bonded (child) <strong>labour</strong>ers) are not able to pay back <strong>the</strong> debts <strong>and</strong> <strong>the</strong> ever<br />

<strong>in</strong>creas<strong>in</strong>g <strong>in</strong>terest.<br />

11. In <strong>the</strong> rural areas <strong>of</strong> Tamil Nadu, a lack <strong>of</strong> programmes for agricultural development, water<br />

<strong>and</strong> irrigation mana<strong>gem</strong>ent for farmers, a lack <strong>of</strong> alternative <strong>in</strong>come-generat<strong>in</strong>g projects <strong>and</strong><br />

absence <strong>of</strong> legal (government) support for <strong>the</strong> form<strong>in</strong>g <strong>of</strong> syn<strong>the</strong>tic <strong>gem</strong> stone workercooperatives,<br />

forces many under- <strong>and</strong> unemployed people to take up <strong>the</strong> job <strong>of</strong> syn<strong>the</strong>tic <strong>gem</strong><br />

stone polish<strong>in</strong>g. They become victims <strong>of</strong> <strong>the</strong> system <strong>of</strong> debt bondage which is practised by<br />

local entrepreneurs. These entrepreneurs control almost <strong>the</strong> whole region <strong>of</strong> Tamil Nadu,<br />

especially <strong>the</strong> areas <strong>of</strong> Trichy <strong>and</strong> Pudukottai District. Bonded child <strong>labour</strong>, especially <strong>in</strong> <strong>the</strong><br />

grow<strong>in</strong>g syn<strong>the</strong>tic <strong>gem</strong> stone <strong>in</strong>dustry <strong>of</strong> Tamil Nadu, is <strong>the</strong> consequence.<br />
