Bonded child <strong>labour</strong> <strong>in</strong> <strong>the</strong> syn<strong>the</strong>tic <strong>gem</strong> polish<strong>in</strong>g <strong>in</strong>dustry <strong>of</strong> Trichy<br />

all o<strong>the</strong>r areas by <strong>the</strong> year 1995, with <strong>the</strong> aim to totally elim<strong>in</strong>ate all bonded child <strong>labour</strong> by <strong>the</strong><br />
year 1998 <strong>and</strong> to obta<strong>in</strong> <strong>the</strong> achievement contemplated for 1988 <strong>in</strong> <strong>the</strong> year 2000.<br />
The State Plan <strong>of</strong> Action <strong>of</strong> 1993 <strong>in</strong>cludes strategies 190 to elim<strong>in</strong>ate (bonded) child <strong>labour</strong>, such as<br />
ensur<strong>in</strong>g <strong>the</strong> availability <strong>of</strong> credit for parents, mobiliz<strong>in</strong>g <strong>of</strong> youth groups, NGOs, teachers etc. to<br />
dissuade parents from bond<strong>in</strong>g <strong>the</strong>ir children. Accord<strong>in</strong>g to <strong>the</strong> Plan, NGOs, field functionaries<br />
<strong>and</strong> teachers will be mobilized to give counsell<strong>in</strong>g <strong>and</strong> support to parents. In <strong>the</strong> Plan also it is<br />
stated that immediate action <strong>of</strong> revenue <strong>of</strong>ficials <strong>and</strong> <strong>the</strong> police is required to charge cases aga<strong>in</strong>st<br />
employers <strong>and</strong> parents for bond<strong>in</strong>g children. It means that <strong>the</strong> law has to be enforced<br />
immediately. None <strong>of</strong> <strong>the</strong> above mentioned actions <strong>and</strong> strategies have been undertaken up to<br />
date.<br />
7.1.2 Review <strong>of</strong> a study 191 on bonded (child) <strong>labour</strong> <strong>in</strong> syn<strong>the</strong>tic <strong>gem</strong> polish<strong>in</strong>g<br />
<strong>in</strong>dustry <strong>in</strong> Tamil Nadu<br />
A study conducted <strong>in</strong> 1993-94 on bonded <strong>labour</strong> <strong>in</strong> <strong>the</strong> <strong>gem</strong> polish<strong>in</strong>g <strong>in</strong>dustry <strong>in</strong> Trichy <strong>and</strong><br />
Pudukottai District revealed that <strong>the</strong> system <strong>of</strong> 'debt bondage' is widely prevalent among <strong>the</strong><br />
people, <strong>in</strong>clud<strong>in</strong>g children, who are <strong>in</strong>volved <strong>in</strong> <strong>the</strong> syn<strong>the</strong>tic <strong>gem</strong> polish<strong>in</strong>g <strong>in</strong>dustry <strong>in</strong> <strong>the</strong>se<br />
areas. The researcher argues that bonded <strong>labour</strong> <strong>in</strong> <strong>the</strong> districts is not a pre-capitalist form <strong>of</strong><br />
production but, ra<strong>the</strong>r a part <strong>of</strong> a dynamic, capitalist small-scale <strong>in</strong>dustry that is rapidly exp<strong>and</strong><strong>in</strong>g<br />
<strong>in</strong>to global markets. The owners <strong>of</strong> <strong>the</strong> syn<strong>the</strong>tic <strong>gem</strong> polish<strong>in</strong>g units make enormous pr<strong>of</strong>its by<br />
mak<strong>in</strong>g <strong>the</strong>ir employees unfree or bonded <strong>in</strong> <strong>the</strong>ir <strong>labour</strong> by encourag<strong>in</strong>g <strong>the</strong>m to take loans. The<br />
loans with very high <strong>in</strong>terests can never be paid back by <strong>the</strong> workers who are obliged to stay <strong>and</strong><br />
work for <strong>the</strong> employer to pay back <strong>the</strong> loan plus <strong>in</strong>terest. In this way <strong>the</strong> employer, through <strong>the</strong><br />
debts, controls <strong>the</strong> <strong>labour</strong> <strong>and</strong> is entitled to pay lower wages to <strong>the</strong> workers because a section <strong>of</strong><br />
<strong>the</strong> wage is meant for debt solv<strong>in</strong>g. Thus, as <strong>the</strong> study revealed, <strong>the</strong> system <strong>of</strong> debt bondage<br />
enabled employers to convert wages <strong>in</strong>to debt with <strong>the</strong> consequence that workers were represented<br />
as repay<strong>in</strong>g <strong>the</strong>ir debts through <strong>the</strong>ir work, ra<strong>the</strong>r than earn<strong>in</strong>g wages. The study revealed<br />
fur<strong>the</strong>r that though <strong>the</strong> majority <strong>of</strong> <strong>the</strong> workers compla<strong>in</strong>ed about <strong>the</strong> very low wages, most <strong>of</strong> <strong>the</strong><br />
workers appeared to feel that, because <strong>of</strong> <strong>the</strong>ir 'debt relation' - <strong>and</strong> <strong>of</strong>ten k<strong>in</strong>ship relation - to <strong>the</strong><br />
workshop owner, <strong>the</strong>y could hardly engage <strong>in</strong> worker unions or openly resist <strong>the</strong> dem<strong>and</strong>s <strong>of</strong> owners.<br />
The workers had to work for long hours <strong>and</strong> lost job-mobility as soon as <strong>the</strong>y had taken a<br />
loan. Thus, <strong>the</strong> loans provided was <strong>the</strong> strategy that employers <strong>of</strong> <strong>the</strong> syn<strong>the</strong>tic <strong>gem</strong> stone<br />
190 Dur<strong>in</strong>g field visits <strong>in</strong> Trichy, an <strong>in</strong>terview was held with <strong>the</strong> Bridge Foundation (BF), a NGO based <strong>in</strong> Bangalore, which is also active on a<br />
small scale <strong>in</strong> <strong>the</strong> syn<strong>the</strong>tic <strong>gem</strong> polish<strong>in</strong>g <strong>in</strong>dustry <strong>in</strong> <strong>and</strong> around Trichy. BF gives f<strong>in</strong>ancial support to <strong>in</strong>dividuals <strong>and</strong> also to cooperatives <strong>of</strong><br />
workers organized by <strong>the</strong> local people <strong>the</strong>mselves. The director said that <strong>the</strong>ir project <strong>in</strong> <strong>the</strong> syn<strong>the</strong>tic <strong>gem</strong> polish<strong>in</strong>g <strong>in</strong>dustry <strong>in</strong> Trichy was a smallscale<br />
one <strong>and</strong> <strong>the</strong>y ma<strong>in</strong>ly focused on women. Three reasons for <strong>the</strong>ir strategy: Firstly, BF did not take <strong>the</strong> risk <strong>of</strong> lett<strong>in</strong>g <strong>the</strong>ir staff get caught by a<br />
highly dangerous mafia operat<strong>in</strong>g <strong>in</strong> <strong>the</strong> villages. Secondly, BF ma<strong>in</strong>ly worked with women because <strong>the</strong>y were not bought by <strong>the</strong> middlemen (i.e.<br />
most <strong>of</strong> <strong>the</strong> women were not bonded <strong>labour</strong>ers) <strong>and</strong> through women far<strong>the</strong>r-reach<strong>in</strong>g changes could be established. Thirdly, BF stimulated small<br />
bus<strong>in</strong>esses which were formed by <strong>the</strong> people <strong>the</strong>mselves. These, should form a block aga<strong>in</strong>st <strong>the</strong> operat<strong>in</strong>g mafia <strong>and</strong> prevent <strong>the</strong>mselves from<br />
becom<strong>in</strong>g bonded <strong>labour</strong>ers. The idea was that an <strong>in</strong>dividual who had started his bus<strong>in</strong>ess with <strong>the</strong> help <strong>of</strong> BF, started to work with his or her family<br />
<strong>and</strong> <strong>the</strong> family started to work with <strong>the</strong> local community. In this way <strong>the</strong> community could slowly build up a cooperative among <strong>the</strong>mselves <strong>and</strong> circumvent<br />
<strong>the</strong> mafia which made people bonded <strong>labour</strong>ers <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> children.<br />
