In order to identify the reasons that, in the case<br />
of PVC, prompted the European Union<br />
to consider possible restrictions on what is one<br />
of the most widely used plastics in the world,<br />
by virtue of its extreme versatility, it is<br />
necessary to put oneself in the shoes of<br />
the EU legislator who, as mentioned in<br />
the introduction, has the protection of the<br />
environment and European citizens as his<br />
primary objective. It is therefore understandable<br />
how Europe could consider as an unacceptable<br />
risk that PVC can release extremely hazardous<br />
compounds such as dioxins and furans during<br />
manufacture or combustion.<br />
This is why ECHA (European Chemicals Agency)<br />
has recently received a formal mandate from<br />
the Commission to conduct investigations in<br />
preparation for the finalisation of a legislative<br />
proposal to restrict the use of PVC.<br />
The aim of the investigation (to be completed by<br />
May <strong>2023</strong>) will be to gather information on<br />
the potential risks arising from the use<br />
of PVC and the presence of the various additives<br />
in PVC itself. The survey will be conducted over<br />
the entire life cycle of PVC and will also<br />
have to consider the socio-economic aspects of<br />
possible alternatives to PVC and the additives<br />
used.<br />
It is a different case for PFAS, which represent<br />
a large family of almost 5,000 chemical<br />
compounds that have been widely used since<br />
the 1950s throughout society and globally.<br />
The problem with PFAS is their extreme<br />
resistance to degradation, which makes them<br />
extremely persistent, so that if released into the<br />
environment, they will continue to accumulate<br />
to the point of contaminating drinking water<br />
and foodstuffs. Because of these considerations,<br />
the competent authorities of Germany,<br />
Denmark, the Netherlands, Sweden and Norway<br />
agreed on the need to limit the risks arising<br />
from the production and marketing of PFAS,<br />
PFAS o sostanze perfluoroalchiliche.<br />
Per individuare le motivazioni che, nel caso del<br />
PVC, hanno spinto l’Unione europea a valutare<br />
possibili restrizioni su quella che è una delle<br />
materie plastiche più utilizzate al mondo, in<br />
virtù della sua estrema versatilità, è necessario<br />
mettersi nei panni del legislatore comunitario<br />
che, come detto in premessa, ha come obiettivo<br />
primario la protezione dell’ambiente e dei<br />
cittadini europei. Si comprende quindi come<br />
l’Europa non possa non vedere come un rischio<br />
inaccettabile il fatto che, in fase di fabbricazione<br />
o in caso di combustione, il PVC possa rilasciare<br />
composti estremamente pericolosi come diossine<br />
e furani.<br />
Per questo motivo l’ECHA (Agenzia europea per<br />
le sostanze chimiche) ha recentemente ricevuto<br />
un mandato formale dalla Commissione, che la<br />
incarica di condurre delle indagini propedeutiche<br />
alla finalizzazione di una proposta legislativa<br />
volta a limitare l’uso del PVC. Obiettivo<br />
dell’indagine, che dovrà concludersi entro<br />
maggio <strong>2023</strong>, sarà la raccolta di informazioni sui<br />
potenziali rischi derivanti dall’impiego del PVC<br />
e dalla presenza dei vari additivi nel PVC stesso.<br />
L’indagine verrà condotta sull’intero ciclo di vita<br />
del PVC e dovrà tenere conto anche degli aspetti<br />
socioeconomici inerenti alle possibili alternative<br />
del PVC e degli additivi utilizzati.<br />
Caso differente invece per i PFAS, i quali<br />
rappresentano una grande famiglia di quasi 5.000<br />
composti chimici ampiamente utilizzati sin dagli<br />
anni Cinquanta nell’intera società e a livello<br />
mondiale. Il problema dei PFAS è rappresentato<br />
dalla loro estrema resistenza alla degradazione,<br />
aspetto che li rende estremamente persistenti,<br />
ragion per cui, qualora rilasciati nell’ambiente,<br />
continueranno ad accumularsi fino a contaminare<br />
l’acqua potabile e gli alimenti. Sulla base di tali<br />
considerazioni le Autorità competenti di Germania,<br />
Danimarca, Olanda, Svezia e Norvegia hanno<br />
condiviso la necessità di limitare i rischi derivanti<br />
dalla produzione e commercializzazione dei PFAS,<br />
