for requirements for overcoming/eliminating
architectural barriers. For example, although
it meets the Essential Safety Requirements of
Machinery Directive 2006/42/EC, the installation
of a lifting platform with a speed of 0.15 m/s or a
height difference of more than 4 m does not meet
the requirements of Ministerial Decree 236/89
and, consequently, does not fall within the
scope of interventions that can benefit from the
specific tax relief for the removal of architectural
barriers, including the 75% deduction.
With a view to favouring taxpayers and, above
all, the categories that most need accessibility
improvement works, it is therefore desirable
for the Government to intervene as soon as
possible to provide a solution to a problem that
has been dragging on for more than thirty years,
recognising that Ministerial Decree 236/89 must
be considered supplemented (if not superseded
or tacitly abrogated), by subsequent, specific
legislation of Community origin for lifts, stairlifts
and elevating platforms and, therefore, to date,
by the decrees of national transposition of the
Lifts Directive and the Machinery Directive
respectively. •

delle barriere architettoniche, compresa la

Nell’ottica di favorire i contribuenti e,
soprattutto, le categorie che più necessitano di
opere volte a migliorare l’accessibilità, è pertanto
auspicabile che il Governo intervenga il prima
possibile per dare soluzione a un problema che
si trascina da oltre trent’anni, riconoscendo
che il DM 236/89 deve ritenersi integrato
(se non superato o tacitamente abrogato),
dalla successiva specifica legislazione di
origine comunitaria per ascensori, montascale
e piattaforme elevatrici e, quindi, ad oggi
rispettivamente dai decreti di recepimento
nazionale della Direttiva Ascensori e della
Direttiva Macchine. •

Silvia Migliavacca an engineer, with a master’s
degree and professional qualification from Milan
Polytechnic, took on the role of Secretary of
ANIE AssoAscensori (National Association
of Elevator and Escalator Industries) in
2005, after many years of association
experience in the domestic and
professional equipment sector. With
the all-round vision of the sectorʼs
issues offered by the role she occupies
in the Association, she coordinates
institutional activities, ensures technicalregulatory
supervision and constant
monitoring of the most significant indicators
for the sector, and organises and promotes the
Association’s info-training activities and initiatives.

Silvia Migliavacca, ingegnere, con laurea magistrale

presso il Politecnico di Milano, nel 2005 ha
assunto l’incarico di Segretario di ANIE
AssoAscensori (Associazione Nazionale
Industrie Ascensori e Scale Mobili), dopo
un’esperienza associativa pluriennale
nel settore degli apparecchi domestici e
professionali. Con la visione a 360° sulle
problematiche del comparto offerta dal
ruolo occupato in Associazione, coordina
l’attività istituzionale, assicura il presidio
tecnico-normativo e il costante monitoraggio
degli indicatori più significativi per il settore.
Organizza e promuove l’attività di info-formazione e le
iniziative dell’Associazione.
