The Budget Law <strong>2023</strong> confirms until 31st<br />
December 2025 the 75% deduction<br />
on interventions aimed at eliminating<br />
architectural barriers.<br />
In Italy, with the publication of Law No. 197<br />
of 29 December 2022 (Budget Law <strong>2023</strong>), the<br />
75% deduction is extended for a further three<br />
years for interventions aimed at overcoming and<br />
eliminating architectural barriers in existing<br />
buildings. The measure had been introduced<br />
last year by Law No. 234/2021 (Budget Law<br />
2022), only for expenses incurred in 2022, to<br />
supplement the benefits already provided by the<br />
tax regulations:<br />
• the Irpef deduction for building renovation of<br />
the property, governed by article 16-bis of the<br />
Tuir (paragraph 1, letter e),<br />
• the 110% deduction (Superbonus), envisaged,<br />
for the expenses incurred from 1 st January 2021,<br />
for subordinate interventions, i.e. carried out in<br />
conjunction with others interventions that are<br />
regarded as principal by the regulations.<br />
The so-called ‘architectural barriers bonus’<br />
consists of a tax deduction of 75% of the<br />
documented expenses incurred from 1 st January<br />
2022 to 31 st December 2025, calculated on a<br />
total amount not exceeding:<br />
• 50,000 euros, for single-family buildings or<br />
for building units located within multi-family<br />
buildings that are functionally independent<br />
and have one or more independent accesses<br />
from the outside;<br />

al 31 dicembre 2025 la detrazione al 75%<br />
sugli interventi destinati all’eliminazione<br />
delle barriere architettoniche.<br />
In Italia, con l’entrata in vigore della Legge n. 197<br />
del 29 dicembre 2022 (Legge di Bilancio <strong>2023</strong>),<br />
è estesa per un ulteriore triennio la detrazione al<br />
75% per la realizzazione di interventi finalizzati<br />
al superamento e all’eliminazione delle barriere<br />
architettoniche in edifici già esistenti. La misura<br />
era stata introdotta lo scorso anno dalla Legge<br />
n. 234/2021 (Legge di Bilancio 2022), solo per<br />
le spese sostenute nel 2022, a integrazione delle<br />
agevolazioni già previste dalla normativa tributaria:<br />
• la detrazione Irpef per ristrutturazione edilizia<br />
dell’immobile, disciplinata dall’articolo 16-bis<br />
del Tuir (comma 1, lettera e),<br />
• la detrazione del 110% (Superbonus),<br />
prevista, per le spese sostenute dal 1° gennaio<br />
2021, per i cosiddetti interventi “trainati”,<br />
se eseguiti congiuntamente agli interventi<br />
“trainanti” previsti dalla specifica normativa.<br />
Il cosiddetto “bonus barriere architettoniche”<br />
consiste in una detrazione d’imposta del 75%<br />
delle spese documentate sostenute dal 1° gennaio<br />
2022 al 31 dicembre 2025, calcolata su un importo<br />
complessivo non superiore a:<br />
• 50.000 euro, per gli edifici unifamiliari o<br />
per le unità immobiliari situate all’interno di<br />
edifici plurifamiliari che siano funzionalmente<br />
indipendenti e dispongano di uno o più accessi<br />
autonomi dall’esterno;<br />
