Article XX<br />

Working Conditions <strong>of</strong> Non-Teaching Assistants<br />

A. Work Schedule<br />

1. In order to meet the needs <strong>of</strong> the school an NTA may be assigned regular<br />

hours for the beginning and ending <strong>of</strong> his/her work differing from those set<br />

forth in Article XVII Section B(2), provided that such different hours shall be<br />

uniform for all days <strong>of</strong> the week, shall remain in effect for a substantial part <strong>of</strong><br />

the school year and shall not result in increasing the total number <strong>of</strong> his/her<br />

daily hours a week. Five (5) working days notice <strong>of</strong> a change in schedule shall<br />

be given to employees.<br />

2. In the event that an NTAs luncheon period is interrupted for the purpose<br />

<strong>of</strong> performing his/her duties, his/her regular time for ending work shall be<br />

reduced by an amount <strong>of</strong> time equal to the duration <strong>of</strong> the interruption <strong>of</strong> his/<br />

her lunch period. NTAs shall receive one (1) fifteen (15) minute break per day<br />

as scheduled by the Principal.<br />

3. In case <strong>of</strong> compelling need at his/her school, an NTA may be required to<br />

work on one (1) or more <strong>of</strong> the days on which instruction is not being conducted<br />

in the school during the winter and spring vacations. In such event, notwithstanding<br />

the overtime provisions <strong>of</strong> Article XII, Section F, the NTA will, in<br />

addition to his/her salary be paid for work on any such day a whole day’s pay<br />

irrespective <strong>of</strong> the number <strong>of</strong> hours worked, not in excess <strong>of</strong> eight (8).<br />

4. Notice that work will be required on any such day shall, whenever possible,<br />

be given at least twenty-four (24) hours before that day. An NTA for whom<br />

work on such day would cause a hardship shall not be required to work on such<br />

day. In the event none <strong>of</strong> the NTAs in a school is available, because <strong>of</strong> this provision,<br />

for such assignment, volunteers therefore may be obtained from among<br />

NTAs in other schools. In the event there are insufficient volunteers, the least<br />

senior NTAs will be required to work, provided that any time worked under<br />

this circumstance, NTAs will be paid at the applicable overtime rate.<br />

5. Assignments to work on days during the winter and spring vacations shall<br />

be divided as equally as possible among the NTAs in the school.<br />

6. NTAs shall be assigned to no more than three (3) consecutive lunchroom<br />

periods.<br />

7. When an employee is required to work overtime or on call-in time, notification<br />

<strong>of</strong> such duty shall be given, if possible, at least by 3:00 on the day preceding<br />

the overtime or call-in work period.<br />

8. Overtime work, other than for required attendance at court, shall not be<br />

required <strong>of</strong> any employee for whom assignment to such work would be a<br />

hardship.<br />

9. Overtime work will be divided as nearly equally as possible among the<br />

NTAs in a given school.<br />

10. In the event an employee seeks a part <strong>of</strong> his/her vacation during the<br />

school year, his/her request shall be approved provided the needs <strong>of</strong> the school<br />

do not require otherwise.<br />
