XXIII. Working Conditions <strong>of</strong> Food Service Managers<br />

B. Duties<br />

1. Food service managers shall not be required to transport food in their<br />

personal vehicles.<br />

2. Food service managers shall not be required to remove trash, mop floors,<br />

or lift or push heavy cartons.<br />

3. The provisions <strong>of</strong> Article XII, Section M regarding acting pay do not apply<br />

to the relief manager.<br />

C. Support Services, Facilities and Supplies<br />

1. Facilities that are available to teachers shall also be available to food service<br />

managers.<br />

Article XXiV<br />

Working Conditions <strong>of</strong> Per Diem Substitute <strong>Teachers</strong><br />

A. Work Schedule<br />

The workday for employees shall be the teacher workday <strong>of</strong> the school to<br />

which they are assigned.<br />

B. Assignments and transfers<br />

1. A substitute teacher shall not be barred from assignment to a specific<br />

school nor removed from the list <strong>of</strong> eligible substitute teachers except for just<br />

cause. A copy <strong>of</strong> the recorded reasons shall be furnished to the employee.<br />

2. A substitute teacher shall be entitled to a conference with the appropriate<br />

administrator who has initiated the action, which may be held after school<br />

hours. He/she may have a <strong>Federation</strong> representative present at such conference.<br />

3. A per diem substitute teacher may be removed from the substitute teacher<br />

list by action <strong>of</strong> the Office <strong>of</strong> Human Resources and become ineligible for<br />

assignment when evaluated as unsatisfactory or when there are repeated<br />

absences, or refusal to accept assignments as specified in this Agreement or for<br />

other just cause. The Office <strong>of</strong> Human Resources shall notify such employee in<br />

writing prior to removing his/her name from the list.<br />

4. An employee shall have the right, upon request, to a hearing to appeal a<br />

recommendation for such removal from the list <strong>of</strong> eligible substitute teachers to<br />

the Executive Director <strong>of</strong> Human Resources. Such hearing shall be conducted<br />

by a designee <strong>of</strong> the Executive Director <strong>of</strong> Human Resources. A decision shall<br />

be issued on such appeal within twenty (20) days <strong>of</strong> the date <strong>of</strong> appeal. The<br />

<strong>Federation</strong> may appeal a decision related to the limitation <strong>of</strong> assignment in a<br />

school or schools to arbitration under the dispute resolution provisions <strong>of</strong> this<br />

Agreement.<br />

5. Seniority shall be calculated by the number <strong>of</strong> units <strong>of</strong> service as defined in<br />

Paragraph 10 <strong>of</strong> this Article for per diem substitute teachers having worked<br />

twenty-two (22) days or more within the <strong>School</strong> <strong>District</strong> <strong>of</strong> <strong>Philadelphia</strong>.<br />
