XX. Working Conditions <strong>of</strong> Non-Teaching Assistants<br />

ments, to summer employment in that school on the basis <strong>of</strong> the highest NTA<br />

school seniority <strong>of</strong> all NTAs for whom it is the home school.<br />

(d) Those ten (10) month NTAs who apply for summer employment, but who<br />

have not designated their home school in their application, or whose home school<br />

is not conducting any activity at any time during the summer or who are not<br />

entitled on the basis <strong>of</strong> their seniority to summer employment in their home<br />

school, shall be assigned on the basis <strong>of</strong> their systemwide seniority as an NTA.<br />

6. An employee who has been forced transferred may file a right-to-return to<br />

his/her former work location within one (1) year <strong>of</strong> the effective date <strong>of</strong> his/her<br />

new assignment. The right-to-return transfer must be refiled each year in order<br />

to remain valid.<br />

C. NTAs will be provided with on-going pr<strong>of</strong>essional development to enhance<br />

their ability to manage student behavior.<br />

D. Duties<br />

1. The duties <strong>of</strong> NTAs include non-teaching duties heret<strong>of</strong>ore or presently<br />

performed by teachers, and other related duties as assigned.<br />

2. Duties may be assigned to NTAs by the Principal <strong>of</strong> the school in which<br />

they work and such duties are performed under the general supervision <strong>of</strong> the<br />

school’s Principal or Assistant Principal.<br />

E. equipment, Supplies and Facilities<br />

1. An adequate clothing locker shall be made available to each employee.<br />

Where the space is available and when his/her duties require it, an employee<br />

shall be provided with a work location so equipped as to enable him/her with<br />

reasonable comfort and efficiency to carry out such duties.<br />

F. examinations and Appointment<br />

1. In preparing lists from which appointments are to be made, wherever<br />

there are identical scores, position on the list shall be determined by school<br />

system seniority.<br />

2. Appointment to the position <strong>of</strong> twelve (12) month NTA shall be made on<br />

the basis <strong>of</strong> system-wide seniority from among those ten (10) month NTAs<br />

applying for such positions who are rated satisfactory on the date <strong>of</strong> appointment<br />

and are not subject to any pending disciplinary process.<br />

3. Not less than seven (7) school days before the appointment is to be made<br />

notice there<strong>of</strong> shall be posted in every school. A ten (10) month NTA desiring<br />

to apply for such a position shall do so on a form to be furnished by the<br />

Principal.<br />

4. The Principal and Building Committee shall jointly formulate the criteria<br />

to be used in the selection <strong>of</strong> an NTA for an assignment within a school, including<br />

the position <strong>of</strong> “Lead NTA”, provided, however, that participation in other<br />

uncompensated duties or activities within the <strong>School</strong> <strong>District</strong> shall not be one <strong>of</strong><br />

such criteria. In the event <strong>of</strong> inability to agree on the criteria, the determination<br />

<strong>of</strong> the Principal shall be final, provided it is neither arbitrary nor capricious. All<br />
