XXV. Working Conditions <strong>of</strong> Pr<strong>of</strong>essional Technical Employees<br />

5. All employees in the bargaining unit shall be eligible to opt for compensatory<br />

time in lieu <strong>of</strong> overtime. Requests to utilize compensatory time must be<br />

submitted at least three (3) days in advance and must be approved by the<br />

employee’s immediate supervisor and the division director. Permission will not<br />

be unreasonably withheld, however, it will not be granted where the employee’s<br />

absence will interfere with the effective operation <strong>of</strong> the department. Special<br />

consideration will be given to personal emergencies requiring immediate<br />

attention.<br />

6. In the event an additional second shift is established in any department in<br />

the bargaining unit to begin at 3:00 p.m. or thereafter, employees working on<br />

such shift shall receive, effective September 1, 1975, fifty cents (.50) per hour<br />

more than is payable in their respective classifications for day shift work.<br />

B. Assignment and transfer<br />

1. An employee in the series <strong>of</strong> classifications listed in Appendix “B”, after<br />

appointment to the entry level position <strong>of</strong> the series in a specific classification,<br />

shall be advanced to the higher levels within the series if the employee:<br />

(a) has received a satisfactory rating for the time spent in the lower<br />

classification;<br />

(b) is capable <strong>of</strong>, and is performing the full scope <strong>of</strong> duties and responsibilities<br />

<strong>of</strong> the higher level;<br />

(c) meets the minimum training and experience requirements for the higher<br />

level position as listed in the job description;<br />

2. Such employee shall receive a promotional increase in accordance with<br />

the standard <strong>School</strong> <strong>District</strong> policy governing promotions.<br />

3. An employee shall have the right to transfer within his/her position classification.<br />

However, before such transfer can be effected, the employee must<br />

demonstrate his/her knowledge <strong>of</strong> the specific skills required by the new position,<br />

e.g., programming language.<br />

4. The Assignment and Transfer provisions <strong>of</strong> Article XIX, Section B shall<br />

apply.<br />

5. Subject to residence requirements, regularly appointed employees, who<br />

are displaced because <strong>of</strong> a program reduction or elimination <strong>of</strong> jobs shall have<br />

the right based on seniority to transfer to a vacant position similar to the one<br />

which the employee held prior to such reduction or elimination, or to a vacant<br />

lower paid position. In the event no such vacancies exist at the time the employee<br />

is displaced then the employee shall be placed on a preferential list for a period<br />

<strong>of</strong> two (2) years and during this period vacancies for such positions shall be<br />

filled from the employees on this list until they shall have had the opportunity<br />

to be <strong>of</strong>fered such employment.<br />

6. When an employee accepts an appointment to a permanent position not<br />

covered by this Agreement, his/her seniority as defined in this Section shall<br />

cease to accumulate. Should such an employee return to a position in the bargaining<br />

unit within one (1) year <strong>of</strong> the date on which he/she left his/her position<br />
