XVIII. Working Conditions <strong>of</strong> <strong>Teachers</strong><br />

8. In addition to the foregoing, the <strong>School</strong> <strong>District</strong> shall maintain special education<br />

classes with the class size maximum required by the Pennsylvania<br />

Department <strong>of</strong> Education as they may be amended from time to time and<br />

posted on the Pennsylvania Department <strong>of</strong> Education’s website.<br />

9. The mutual goal <strong>of</strong> the parties is to eliminate split classes in elementary<br />

schools. To that end, split classes shall be eliminated unless they are required to<br />

meet the physical constraints <strong>of</strong> a school building or for budgetary requirements.<br />

In such cases, the Principal shall provide the reason(s) in writing to the<br />

teacher <strong>of</strong> the class in which this has occurred.<br />

Article XiX<br />

Working Conditions <strong>of</strong> Secretaries<br />

A. Work Schedule<br />

1. Twelve (12) month secretaries currently assigned on September 1, 2000 to<br />

administrative <strong>of</strong>fices shall work no more than a total <strong>of</strong> three (3) days during<br />

the Winter and Spring holidays.<br />

2. Any current ten (10) month secretary assigned on September 1, 2000 who<br />

transfers to a twelve (12) month position in an administrative <strong>of</strong>fice shall work<br />

no more than five (5) days during the Winter and Spring holidays.<br />

3. Any secretary hired on or after January 1, 2001, who is assigned to an<br />

administrative <strong>of</strong>fice, shall be entitled to take vacation days during the Winter<br />

and Spring holidays.<br />

B. Assignment and transfers<br />

1. A satisfactory employee may apply for a summer position, and in the order<br />

<strong>of</strong> system seniority shall be assigned to such position if the position exists, provided<br />

that he/she meets the criteria posted for the position.<br />

2. Secretaries shall be given home school preference for summer school and/<br />

or summer program assignments.<br />

3. Transfers are granted on the basis <strong>of</strong> seniority <strong>of</strong> service. Seniority is calculated<br />

from the effective date <strong>of</strong> appointment or <strong>of</strong> the last voluntary transfer,<br />

except when an employee has received a forced transfer.<br />

4. Transfers are granted to the same type <strong>of</strong> position only. Appointments to<br />

other types <strong>of</strong> position are made from an eligible list. A person whose name is<br />

on more than one (1) list, in accepting an appointment, does not have his/her<br />

name removed from the other list, and may be assigned to the other type <strong>of</strong><br />

work at such time as his/her name is reached. Such later assignment is not a<br />

transfer.<br />

5. To be eligible for transfer, an employee must serve for at least one (1) year<br />

in the position to which he/she has been appointed from an eligibility list or to<br />

which he/she has voluntarily transferred.<br />
